    Land Tenure Working Paper 20. This paper presents an analysis of communal tenure and its role for natural resource management system, in different contexts of selected Asian countries. The current market driven pressures on natural resources create both challenges and opportunities for communities and governments to use and strengthen communal tenure in order to promote sustainable management of some natural resources.

    In implementing the provisions of Article 47, paragraph 2, of the Constitution, this Law establishes the subjects which may be permitted to acquire into ownership non-agricultural land plots for conducting in Lithuania activities provided for in this Law; conditions, procedure and restrictions in compliance with which the subjects established by this Law may acquire into ownership a plot of land; grounds for determining the size of the land plot being acquired into ownership.

    Since the 1970s and 1980s, community-based forestry has grown in popularity, based on the concept that local communities, when granted sufficient property rights over local forest commons, can organize autonomously and develop local institutions to regulate the use of natural resources and manage them sustainably. Over time, various forms of community-based forestry have evolved in different countries, but all have at their heart the notion of some level of participation by smallholders and community groups in planning and implementation.

    <p>This <i>Free, Prior and Informed Consent (FPIC) Manual</i> is designed as a tool for project practitioners of a broad range of projects and programmes of any development organization, by providing information about the right to FPIC and how it can be implemented in six steps.</p> <p>In an FPIC process, the “how”, “when” and “with and by whom”, are as important as “what” is being proposed. For an FPIC process to be effective and result in consent or lack of it, the way in which the process is conducted is paramount.

    From the outset, the development of agriculture has been strongly associated with women’s endeavour. In fact, women’s contribution to agriculture goes back to the origins of farming and the domestication of animals when the first human settlements were established more than 6 000 years ago. Over the years, the division of responsibilities and labour within households and communities tended to place farming and nutrition-related tasks under women’s domain. Nowadays, in many societies women continue to be mainly responsible for family food security and nutrition.

    Increasing women’s access to land is crucial to fight hunger and poverty. However, gender disparities in land access remain significant in most countries, regardless of their level of development. A new FAO database helps to understand the factors that prevent women from accessing land; and to design better policies to effectively address this situation.

L’étude identifie les enjeux auxquels les Etats doivent faire face ; elle reconnaît également les bonnes pratiques et les initiatives entreprises en matière de la gouvernance de la tenure des terres et des ressources naturelles.

    Most of the world’s poor work in the “informal economy” – outside of recognized and enforceable rules. Thus, even though most have assets of some kind, they have no way to document their possessions because they lack formal access to legally recognized tools such as deeds, contracts and permits. The Commission on Legal Empowerment of the Poor (CLEP) is the first global anti-poverty initiative focusing on the link between exclusion, poverty and law, looking for practical solutions to the challenges of poverty.

    This paper represents part of an area of work in support of enhancing access to land and forest resources in support of rural livelihoods in Mongolia. It is based on learning emerging from an ongoing FAOsupported project called: Support to the development of participatory forest management (TCP/MON/2903). This project has involved the development (through extensive community-level consultations in forest areas) of a detailed Concept Document for the design and implementation of participatory forestry.
