    There is today a growing awareness of the importance of providing rural populations with more secure tenure to land and other natural resources, not least in Africa where approximately 90 percent of all land is still unregistered. At the same time there has been a rethinking of approaches for securing local tenure rights in practice. Experience has shown that the conventional approach, i.e., individual freehold titling, has often not worked well in areas where communal forms of customary tenure predominate, which is still the case in most parts of rural sub-Saharan Africa.

    The Community Land Act of 2016 provides a legal basis for protection, recognition and registration of community lands andhas provisions for management and administration of the land by the communities themselves.     A community’s choice to give, or withhold, their free, prior and informed consent (FPIC) to a project or activity planned to take place on their land is a recognized right of Indigenous peoples under international law. It is also a best practice principle that applies to all communities affected by projects or activities on the land, water and forests that they rely on.
