    In 2001 a new Land Law was adopted in Cambodia. It was significant because - for the first time - it recognised a new legal category of people, Indigenous Peoples or chuncheat daoem pheak tech in Khmer, and it also introduced the legal concept of communal land rights to Cambodia. Indigenous Peoples are not mentioned in the 1993 constitution of Cambodia or any legislation pre-dating the 2001 Land Law. However, Cambodia's 2002 Forestry Law also followed the trend by recognising Indigenous Peoples.

    Despite the tens of millions of dollars in aid and concessional loans being spent in Cambodia with the ostensible aim of securing land tenure and making the management of land and natural resources more equitable and sustainable, the evidence shows that tenure insecurity, forced evictions and large-scale land grabbing are escalating to alarming levels.

    In this paper, we present an analysis of the change in household land use following a conservation-driven process of indigenous land titling reform in a Cambodian protected area. In each of the two study villages, we investigated how household land use had changed and the extent of compliance with both legal boundaries of titled areas and community regulations created to govern land use within these areas. A comparison of current household land holdings in each village with those at the start of the tenure reform process indicated a significant increase in household land holdings.

    OPENING PARAGRAPH OF EXECUTIVE SUMMARY: Whereas 2011 had seen a sharp increase in the number of Economic Land Concessions (ELCs) granted by the Royal Government of Cambodia to private companies, in 2012 conflicts became more acute and protests multiplied. The government showed that it had understood the seriousness of the situation by taking initiatives aimed at resolving land disputes, addressing some of the issues related to ELCs and granting thousands of land titles to rural families.

    Through LMAP, and subsequent LASSP, Cambodia has made impressive progress in building a functioning cadastral system over the last ten years. This process has proved complex and challenging, but since commencing, the land registration teams have successfully issued over 1.7 million land titles, a strong legal framework has been developed for the functioning of the land administration bodies and mechanism, institutions have been built and strengthened, and a dispute resolution process has been established for dealing with disputes over unregistered land.

    ABSTRACTED FROM CHAPTER INTRODUCTION: The preceding chapters of this book give a central place to the Powers of Exclusion framework for understanding transformations in land relations, as developed in our 2011 book on Southeast Asia. A couple of the main aspects of the two books make for an interesting comparison. The first is that each employs a regional frame of reference to explore themes in changing land relations. The second is their respective development and application of a common conceptual framework.

    This paper uses four years of panel data on 793 households collected during 2001–11 to measure chronic poverty in rural Cambodia and to identify its key determinants. A household wealth index—a proxy for long-term welfare—constructed by polychoric principal component analysis is used as welfare indicator. Both ordered logistic and multinomial logistic regression models are adopted to identify the causes of chronic and transient poverty by focusing particularly on five explanatory variables: agricultural land and livestock, demography, human capital, social capital and natural resources.
