Concentration of land ownership, lack of access, insecurity of tenure and lack of efficiency and transparency in land administration services, are among the obstacles towards responsible governance of tenure of land and other natural resources in Latin America. These issues have been the subject of discussions and policy recommendations during many international forums, such as the International Conference on Agrarian Reform and Rural Development (ICARRD) held in Porto Alegre, Brazil, in March 2006.

Under certain circumstances, land titling, property regime changes, and land‐use conversions yield substantial profits. Yet few people possess the wealth, knowledge, and networks to benefit from these procedures. In the Yucatán Peninsula, a region recently targeted as a prominent investment location by the Mexican national government (mainly with the “Tren Maya” megaproject) and the private capital, forestlands collectively owned as ejidos by Mayan peasants are on the trend to complete privatization.

This compendium provides an improved understanding of the complex issues concerning gender and land. It draws on research commissioned by FAO. The authors argue that hunger and poverty are, in general, consequences of inadequate and restricted access to land and other resources, such as capital, inputs and technology; women are among those with less access to land, while accounting for a large share in small-scale food production.Rights to land, especially women’s rights to land, are determined by a complex interaction between the institutions, and underlying power relations, of a society.

This paper analyzes the importance of legal property documents in providing tenure security, enhancing agricultural investment incentives and easing access to credit. While theory predicts that better property rights on land can increase investment through increased security, enhanced trade opportunities and increased collateral value of land, the presence and size of these effects depend crucially on whether those rights are properly enforced. In Nicaragua, a troubled history of land expropriation and invasion has undermined the credibility of the legal property regime.
