The propose of this Decree is to provide for matters delegated by the National Land Planning and Utilization Act and matters necessary to implement the afore-mentioned Act. The Act provides for the general principles of civil law of Estonia. Notably, it defines the concepts of movable and immovable property defining the latter as a delimited part of land (plot of land). This Act amends the Land Act: in section 2 by inserting a new definition of “person who is not a citizen of Malawi”; in section 5(1) which restricts the making of a grant of any public land or any customary land to any person who is not a citizen of Malawi; in section 40 on proof of citizenship of Malawi; by adding new sections (24B, 24C and 24D) which place restrictions on the grant of private land to any person who is not a citizen of Malawi.

Land expropriation shall be governed by this Act.To establish any of the undertakings for public interest purpose as prescribed in Article 3, the State may expropriate private land.
