Women’s rights to land remain a contested issue in Kenya despite the acceptance of the principle of equality of the genders in law. The 2010 Constitution of Kenya clearly provides for the principles of equality and non-discrimination at Article 27. Moreover, in the land policy principles and the national values and principles of governance, gender equality is included. Despite these clear provisions however, gender inequality in land relations persists. The patriarchal social ordering that privileges men in land holding has been a greater barrier to women’s land rights.

Includes inheritance: a key way women access land; local mechanisms: ‘custom’, power dynamics and lack of engagement; formal justice system: community pariah status and systemic barriers. The lack of access to land cannot be framed as a failing of formal or informal systems, but rather as issues with both. The key to increasing access to justice at both formal and informal levels is to address power dynamics and understand how they operate to the detriment of women.

Land is the foundation of all human activities both social and economic. This is particularly so in agrarian economies such as Kenya. In these economies women are central to economic production in agriculture and livestock sectors. In Kenya, where the mainstay of most communities is agriculture and livestock production, women contribute up to 80 % of the workforce. Nevertheless, women only hold 1% of registered land titles in their names and around 5-6 % of registered titles held in joint names.

The Landesa Center for Women’s Land Rights has created four new practice guides, which are practical resources for development practitioners, researchers, lawyers, advocates, and scholars to assess the situation for women’s land rights in three countries: Kenya, Tanzania, and Uganda. They address both the formal legal structure and the customary framework that impact women’s secure access to land. A fourth guide, International Agreements and How to Build a Legal Case for Women’s Land Rights, provides insights and guidance on using international conventions (e.g.

While women’s rights to land and property are protected under the Kenyan Constitution of 2010 and in various national statutes, in practice, women remain disadvantaged and discriminated. The main source of restriction is customary laws and practices, which continue to prohibit women from owning or inheriting land and other forms of property.

Women in most rural communities in Africa dominate farm activities in terms of labour
supply and management. Overall, Africa's performance in terms of agricultural
production and productivity remain inadequate and the region has failed to make progress
in food security (Republic of Kenya, 2002). Therefore, successful agricultural reform
programs will require raising women's productivity. The current study examines the
existence of real evidence that women's limited access to land constitute a significant
