This report uses household-level data from 33, mostly developing, countries to analyse perceptions of tenure insecurity among women. We test two hypotheses: (1) that women feel more insecure than men; and (2) that increasing statutory protections for women, for instance by issuing joint named titles or making inheritance law more gender equal, increases de facto tenure security.

While women’s rights to land and property are protected under the Kenyan Constitution of 2010 and in various national statutes, in practice, women remain disadvantaged and discriminated. The main source of restriction is customary laws and practices, which continue to prohibit women from owning or inheriting land and other forms of property.

The figures of public resources estimated to have been channeled into private pockets are so high one hopes, obviously against hope, that they would turn out to be typographical errors. The land challenge is central to the broader youth dynamics of migration, employment, livelihoods and belonging. The more than 1.8 billion youth living worldwide represent not only a land challenge, but an untapped potential in moving the tenure security agenda forward. Recognizing this, the Global Land Tool Network has partnered with UN-Habitat to develop youth responsive land tools through the Youth-led Action Research on Land program. Five action research projects will be undertaken by youth organizations in Brazil, Kenya, Nepal, Yemen and Zimbabwe.

The cadastral system2 in Kenya was established in 1903 to cater for land alienation for the white settlers. Since then, a hundred years later, the structure of the system has remained more or less the same despite major changes in surveying technology. The government of Kenya has realized that the current structure is not conducive to economic demands of the 21st century and is interested in re-organizing the structure in line with the current constitutional dispensation and new paradigms in land management.

The climate crisis demands urgent action, yet we live in a politically polarized and paralyzed world. As governments and other actors struggle over climate change, our environment is irreversibly changing. A United Nations report on the Global Assessment of Biodiversity and Ecosystem Services revealed that three-quarters of the earth’s land-based environment has been significantly altered by human actions.

Conventional notions of the ‘land parcel’ have been extended: previously unrecognized tenures including customary, nomadic, or communal interests are now incorporated into the concept. Technical tools including the Social Tenure Domain Model (STDM) enable these new understandings to be operationalized in land administration systems. The nomadic pastoralists of Kenya’s dry land regions illustrate where these new approaches can be applied.
