Zambia recognizes two types of land tenure: customary and leasehold tenure. While historically the majority of land in Zambia has been held under customary tenure, leases (also called leasehold titles) are the only legal means of holding land rights.

Government has been implementing the Land Resettlement Programme for over twenty four (24) years, focusing mainly on land resettlement for agricultural purposes without a comprehensive policy and legal framework. This has caused a number of challenges including lack of a coordination mechanism at higher level of Government in the implementation of the land resettlement programme, land disputes and low levels of infrastructure development and service provision in the resettlement schemes.

This report uses household-level data from 33, mostly developing, countries to analyse perceptions of tenure insecurity among women. We test two hypotheses: (1) that women feel more insecure than men; and (2) that increasing statutory protections for women, for instance by issuing joint named titles or making inheritance law more gender equal, increases de facto tenure security.

This chapter investigated threats of statutory tenure on customary land. The study was primarily qualitative in nature and adopted a case study approach. Using evidence from Chamuka Chiefdom in Chisamba District, Central Province, the paper concludes that there are various threats of statutory tenure on customary land. These include traditional leaders losing control over land, displacements, land disputes, investors acquire more land than what is demarcated to them by traditional leaders, traditional leaders’ not consulting their community members, corruption, and tenure insecurity.

In their quest for economic development through increased private investment, many developing countries are reformulating land policies to pave way for the transformation of communal land rights into private property. However, these customary land reform efforts have often been frustrated by indigenous people who feel such proposals threaten rural livelihoods and undermine the traditional political structures. Most of the research on this subject has focused on whether, how and/or to what extent the objectives of land reforms (e.g.

Looking at several large-scale land deals in Mozambique, Tanzania and Zambia, this extraordinary documentary highlights the nuanced impacts of these investments. Small-scale farmers and producers, national government officials, and African policy-makers unpack the deals, showing that there are winners and losers when providing investors access to large tracts of land in Africa. For example, land deals impact differently on women and youth, and altering land regimes also impacts on access to other natural resources such as water, fish, and local indigenous vegetables.

Given the recent trend of granting vast areas of African land to foreign investors, the urgency of placing real ownership in the hands of the people living and making their livelihood upon lands held according to custom cannot be overstated. This study provides guidance on how best to recognize and protect the land rights of the rural poor. Protecting and enforcing the land rights of rural Africans may be best done by passing laws that elevate existing customary land rights up into nations' formal legal frameworks thereby making customary land rights equal to documented land claims.
