    This Law, consisting of five Chapters, regulates the requirements to transfer the land ownership of any immoveable property. It specifies terms and conditions to deal with land, benefits from the land, building and things constructed or situated on that land and things installed on those buildings. It establishes land property restrictions, registration, offences and penalties.

    The cadastral system2 in Kenya was established in 1903 to cater for land alienation for the white settlers. Since then, a hundred years later, the structure of the system has remained more or less the same despite major changes in surveying technology. The government of Kenya has realized that the current structure is not conducive to economic demands of the 21st century and is interested in re-organizing the structure in line with the current constitutional dispensation and new paradigms in land management.

    Various multilateral organisations, for instance the World Bank, the Food and Agricultural Organisation have been at the forefront of the different programmes designed to enhance tenure security of landholders as the basis for long-term agricultural development. This has been the case especially in parts of the world where customary systems of tenure are predominant. Wily argues that ‘so little of sub-Saharan Africa is subject to formal entitlements as legally recognised private properties’.

    Mailo is a unique tenure system in central Uganda. It is divided into three parts: Kabaka’s Mailo, Official Mailo and Private Mailo. Private Mailo belongs to an individual, so-called landowner and it can be sold, subdivided or transmitted. Conflicts on private Mailo can occur between landowners & tenants, tenants & tenants, and landowners & landowners. A key challenge is that there is a lack of knowledge and transparency on land rights on both sides.

    Conventional notions of the ‘land parcel’ have been extended: previously unrecognized tenures including customary, nomadic, or communal interests are now incorporated into the concept. Technical tools including the Social Tenure Domain Model (STDM) enable these new understandings to be operationalized in land administration systems. The nomadic pastoralists of Kenya’s dry land regions illustrate where these new approaches can be applied.

    This brochure presents the approach and core activities of GIZ Global Program on Responsible Land Policy (GPRLP). The GPRLP is active in Benin, Ethiopia, Laos, Madagascar, Paraguay, Peru and Uganda. In each country, a context specific approach in line with the global GPRLP concept aims at improving the access to land as a core condition for combating poverty and hunger in rural areas for specific population groups, particularly women and socially marginalised groups.

    Analysing bureaucratic responsibilities influencing tropical rainforest transformation systems

    Tropical forests in Indonesia are subject to major transformation processes from native forests to other land uses, including rubber agroforestry as well as rubber and oil palm plantation systems. Using content analysis of policy documents, this paper aims at (i) analysing the formal administrative responsibilities related to the four rainforest transformation systems and (ii) based on the informal motives of the competing bureaucracies involved generating hypotheses on their future course of action and related research.
