This Regional Legislative Decree approves the Tourism Planning Programme (POT) of the Autonomous Region of Madeira.
Article 38 (1) shall be amended to add the following wording: “Article 38 (1). The use of agricultural land for rural tourism (agro-tourism). Owners of agricultural land can place on these lands structures for the reception of tourists of the category of agrotouristic boarding house without changing the designation of the respective land. The aforesaid right can be realized if the owner of agricultural land is engaged in agricultural activities for at least five years". Article 99 shall be amended to add the following wording: “Article 99.
El presente Decreto Ley crea los Programas de Desarrollo con Enfoque Territorial (PDET) como un instrumento de planificación y gestión para implementar de manera prioritaria los planes sectoriales y programas en el marco de la Reforma Rural Integral (RRI) y las medidas pertinentes que establece el Acuerdo Final, en articulación con los planes territoriales, en los municipios priorizados en el presente Decreto de conformidad con los criterios establecidos en el Acuerdo Final.
This Regional Legislative Decree, consisting of 18 articles, adapts Law No. 54/2005 on the ownership of water resources to the legislation of the Autonomous Region of Madeira. It regulates the following land ownership issues: Land near the crest of the cliffs reached or inserted in consolidated urban centres; Process of recognition of private property on public land parcels; Administrative easements on private plots of beds and public water banks; Areas threatened by the sea or floods, etc.

This Decree-Law, redefines the Southern Integral Tourism Development Zone (ZDTI) of "Baia das Gatas" within the island of São Vicente. It establishes new configuration of the above mentioned zone, taking into account that the previous amendment did not take into account the people agglomeration of the Northern ZDTI of the Baia das Gatas that is contained in the Southern ZDTI.
