The present Act lays down rules relating to expropriation in the province of Alberta. It applies to any expropriation authorized by the law of Alberta and prevails over any contrary provisions that may be found in the law, except the statutes enumerated in the Schedule.

The present Act lays down provisions relating to the constitution of special areas in the Province of Alberta. For the purpose of the present Act “public land” means land belonging to the Crown in right of Alberta and under the administration of the Minister and “special area” means a special area constituted under this Act. Section 16 rules that no public land situated in a special area shall be sold without the consent of the Minister. Section 29 establishes the Special Areas Board which administrate the special areas. The text consists of 30 sections.

The present Act introduces some amendments to the Land Titles Act (Chapter L-4). In particular, it repeals section 3; as well as section 5 which shall read as follows: “Deputy Registrar. The Deputy Registrar may do and perform all the duties required by this Act to be done or performed by the Registrar.” Furthermore, it adds a chapter after section 43 dealing with proof of identity; and one after section 50 concerning refusal to register.

The present Act provides protection for both parties under a lease or agreement for sale for land where payment is made with the crops grown on said land. In particular, the Act operates when, pursuant to a lease, sale, or first mortgage on a piece of land, there is provision made to pay the rent, purchase money, or mortgage money either in whole or part with crops grown on that land. The maximum amount of any lien or charge which may be charged as a result of the transaction is one third of the value of the crop.

The Lieutenant Governor in Council may make Regulations for the purpose of prohibiting, annulling or in any manner restricting the taking or acquisition directly or indirectly of, or the succession to, any interest in controlled land (as defined), provided that they do not operate so as to prohibit, annul or in any manner restrict the ownership by a person of interests in controlled land consisting of not more than 2 parcels containing, in the aggregate, not more than 20 acres.
