    This Chapter concerns the recording of conveyance of real property and the effects of recording. The term conveyance embraces every instrument in writing by which any estate or interest in real property is created, alienated, mortgaged, or encumbered, or by which the title to any real property may be affected, except wills. Every conveyance of real property acknowledged or proved and certified and recorded as prescribed by law from the time it is filed with the Director of Land Management is constructive notice of the contents thereof to subsequent purchasers and mortgagees.

    This Act amends the Land Management Act so as to introduce a requirement of legislative approval of sale, lease, exchange or otherwise transfer of government land. This rule shall not apply to Land Use Permits, the Land for the Landless Program or residential leases granted by the Chamorro Land Trust Commission pursuant to its Rules and Regulations.

    This Chapter provides for various matters relative to trusts in real property. Trusts shall be in writing in accordance with section 1. Sections 2 and 3 concern the protection of the purchaser of a trust. Section 4 concerns a trust given as security. Other provisions of this Act concern conveyancing of trusts and other dispositions regarding trusts and their legal effects.

    This Chapter regulates certain aspects (requisites, effect of transfer, form of grant, etc.) of the transfer of real property. An estate in real property, other than an estate at will or for a term not exceeding one year, can be transferred only by operation of law, or by an instrument in writing, subscribed by the party disposing of the same, or by his agent thereunto authorized by writing (sect. 1 of Article 1). Section 2 of Artcile 1 defines the form of grant of an estate in real property.

    This Chapter provides for the registration of titles in land, defines effect of registration and regulates various other matters relative to registration of title and ownership of real property such as the examination of title. The Director of Land Management shall be ex officio registrar of titles and may designate one or more employees of the Department of Land Management as deputy registrars of titles (sect. 2).     This Chapter makes provision with respect to unlawful transfers of real property in case of fraudulent transactions. Every instrument, other than a will, affecting an estate in real property, including every charge upon real property, or upon its rents or profits, made with intent to defraud prior or subsequent purchasers thereof, or encumbrancers thereon is void as against every purchaser or encumbrancer, for value, of the same property, or the rents or profits thereof.

    This Chapter regulates the use of Government land and defines uses for specific purposes and for specified parts of Guam. The Director with the approval of the Governor is authorized to grant permits for the use of any suitable government real property, not otherwise occupied or in use, and for any lawful purposes. Articles 2 to 5 provide for use of specific lands and the sale of such land to qualified purchasers. Article concerns a comprehensive development Master plan to be adopted for specified areas.

    Any person having the legal capacity to own land in the Territory of Guam, who has an unbroken chain of title to any interest in land by himself and his immediate and remote grantors since January 1, 1935, and is in possession of such land, shall be deemed to have a marketable record title to such interests, subject only to such claims thereto and defects of title as are not extinguished or barred by the application of the provisions of this Chapter and instruments which have been recorded since January 1, 1935.

    This Chapter defines and classifies servitudes and defines rights and obligations deriving from such land burdens. Easements, i.e. servitudes attached to land include: a) the right of pasture; (b) The right of fishing; (c) the right of taking game; (d) the right of way; (e) the right of taking water, wood, minerals, and other things; (f) and the right of having water flow without diminution or disturbance of any kind. Servitudes not attached to land include the right to pasture, and of fishing and taking game (sects. 1 and 2).
