    This Act amends the Foreshore and Land Reclamation Ordinance, Cap 35 in section 2 by adding definitions and in section 3 with respect to compensation by licence holders to landowners.This amendment is introduced so as to strengthen the recognition of customary rights over the foreshore of lands. Private rights over land expressly include customary rights to the exclusive use of the foreshore of Mauritius lands. Landowners are granted certain rights with respect to the granting of licences for the extraction of materials from the foreshore.

    The State is the owner of land in the Republic, and some of these lands should be made available for development including permanent settlement of citizens and their families, who otherwise have no or limited access to land. The objectives of this Act are on the one hand to provide a framework for the tenure and alienation of such land and on the other hand to provide for the planning and sustainable development of such land in accordance with certain principles.

    This Act grants a priority right to the Government of Kiribati to purchase land from landowners who offer such land for sale: (a) to any person not among the next-of-kin of the transferring owner; or (b) whether the person is next-of-kin or not, to any person for valuable consideration. The Act provides for the acquisition of such land by the State. No owner shall: (a) unconditionally accept an offer to purchase land; or (b) cause an alienation governed by this Act to be effected, without first providing notice to the State in a form set out in Schedule 2 to this Act.

    These amendments and contemporary changes to the Native Lands Ordinance and the Magistrates’ Ordinance, are part of institutional strengthening of the lands and survey work particularly for South Tarawa. The amendments are introduced in order to implement the fairer and more certain settling of dealings with land by owners, lessees, neighbours and purchasers. The amendments to this Ordinance have the effect of bringing subdivision of land under the same system as Native Lands Ordinance transactions (i.e. sales and leases).

    These amendments and contemporary changes to the Land Planning Ordinance, are part of institutional strengthening of the lands and survey work particularly for South Tarawa. By defining subdivision in the Ordinance (clause 2), and by adding Part VIA- Subdivision, persons who wish to divide a plot of land must satisfy the Court that there is sufficient land for the families on each of the subdivided parts. This brings the law on subdivision in line with the law on sale or lease or sublease.

    The ownership of the foreshore and sea-bed vests in the Crown, subject to the public rights of: (a) navigation and fishing, and (b) of passing over the foreshore, and to any private rights that may exist in or over the foreshore or the sea-bed. The Minister may by notice, after consultation with landowners, designate a foreshore of an island or islet or any part thereof. No person shall remove from a designated foreshore any sand, gravel, reef mud, coral, rock or other like substance without first having obtained from the Chief Lands Officer a licence for that purpose.

    The Act consists of 34 sections divided into 5 Parts: Preliminary (I); Establishment, Membership and Procedure of Land Planning Boards (II); Land Use Plans (III); Development Control and Appeals (IV); General (V).A Central Land Planning Board is established under section 4. The Central Board may with the approval of the Minister by notice designate any area for the purposes of this Ordinance. There is hereby established for each designated area a local land planning board.

    Non-native land shall not be alienated, whether by sale, gift, lease or otherwise, unless at least 6 weeks before the alienation notice thereof has been served on the Minister, who may inform the intended vendor that the Crown wishes to acquire the interest intended to be alienated.. Where the Minister and the vendor are unable to agree on terms of transfer the land in question shall be deemed for the purposes of the Crown Acquisition of Lands Ordinance to be required for a public purpose.

    An Act to consolidate Enactments relating to the Administration of the Estates of Deceased Persons.

    This Act concerns the administration of real estate of deceased persons by personal representative of the deceased person or executor by will. The Act also makes provision for the disposal of land subject to this Act and other administration of assets. A testator may appoint, and in default of such express appointment shall be deemed to have appointed, as his or her special executors in regard to settled land, the persons, if any, who are at his or her death the trustees of the settlement thereof, and probate may be granted to such trustees specially limited to the settled land.
