The last decade has witnessed a raft of political and legal reforms in Kenya and the efforts have paid dividends. Kenya is experiencing an unprecedented surge in foreign direct investments in varied infrastructure projects. In most cases the projects are situate in rural areas creating a buzz of excitement and igniting opportunities for poverty reduction initiatives directly or indirectly.
Oil exploitation is relatively a new phenomenon in the Kenyan legal system. The current energy laws, fail to identify and establish a relevant institutional and legislative framework for a natural resource benefits sharing regime. Indigenous Local Communities inhabiting oil rich areas disproportionally forgo their enjoyment of their land, livelihoods, endure environmental degradation, increase pollution and relatively poorer health as compared to the rest f the national population. For the above they ought to be compensated and accorded a percentage benefit over and above other Kenyans.

Underpinned by the concept of entitlement as its theoretical paradigm, this study examines the genesis of public land ownership and its disposition in the post-colonial era, how this has disadvantaged some sections of society and given rise to claims of historical land injustices.
The purpose of this study was to evaluate the Kenya Government housing policies and strategies for housing the urban poor in Kenya, and how the citizen have benefited from the scheme/plan. Objective of the article was to examine the effectiveness of Housing policies and their implementation strategies in the provision of low-cost housing to the urban poor in Kisumu City. The research question was, how effective are the various Kenya Government Housing Policies and implementation strategies targeting the provisions of low-cost Housing to the urban poor in Kisumu City?
Evidence from the first Nairobi Cross-sectional Slum Survey (NCSS) conducted in the city by the African Population and Health Research Center (APHRC) in 2000 revealed that slum residents have the worst health outcomes of any group in Kenya (including rural residents). They have limited access to basic facilities such as water and sanitation, or opportunities for life such as education and employment, and that they endure the near absence of the public sector and law enforcement agencies in their daily lives.
Providing formal titles to residents in densely populated informal settlements without fuelling conflict or encouraging gentrification presents several challenges. It has been argued that, in some contexts, forms of collective tenure such as a Community Land Trust may help to overcome some of these problems. This paper analyses one attempt to legalise informal tenure arrangements, minimise relocation and prevent gentrification by introducing collective titling in an informal settlement in Nairobi.
Kenya’s hurried pursuit of infrastructure developments in the last decade has highlighted the need for effective environmental regulation surrounding the approval, construction and operation of new projects. One such project, the Nairobi-Thika Highway Improvement Project (NTHIP), creates fertile ground for investigation into how well Kenya’s environmental safeguards work. Transforming the road from Nairobi to Thika town into a super highway is one of Kenya’s first large-scale transportation infrastructure projects.
The environmental sector in Kenya is one of great importance. However, attention in its protection and conservation from a legal point of view came to prominence a decade ago with the enactment of the Environmental and Management Coordination Act of 1999 and the subsequent formation of the National Environmental Management Authority under section 7 of the act.
In north-western Kenya, significant oil reserves have been discovered and the first oil trucks have left Turkana County in June 2018. On the east side of Lake Turkana, the largest wind power project on the African continent was completed in mid-2017. This article applies a local to global perspective to explore the benefits and externalities for the local communities living in close proximity to the oil and wind exploitation sites. A particular focus is placed on governance of energy resources, water and employment opportunities and its impacts on new and existing conflict dynamics.
