    El presente Decreto Ley, que consta de 2 artículos, modifica el artículo 6º del Decreto Ley Nº 8/1984, de 3 de mayo, que transfiere al estado la propiedad de las fincas rústicas abandonadas por los extranjeros, disponiendo que se anula totalmente y queda sin efecto todo acto jurídico celebrado con posterioridad al 5 de marzo de 1969 por el propietario registral de un bien abandonado a favor de terceros.

    Enmienda: Decreto Ley Nº 8/1984 - Transfiere al Estado la propiedad de las fincas rústicas abandonadas por los extranjeros. (1984-05-03)

    El presente Decreto Ley, que consta de 8 artículos -vencido el plazo establecido en el Decreto Nº 22/1988, de 20 de febrero, por el que se concede un plazo de 60 días a los extranjeros propietarios de fincas rústicas y urbanas para recuperar sus propiedades y ponerlas en explotación-, tiene por objeto regular de modo definitivo la situación legal de los bienes raíces, rústicos y urbanos, sitos en territorios de Guinea Ecuatorial y que se conozcan como bienes abandonados (art. 1º).

    "Land" is defined in this Act as "any parcel of land held for a Government lease as defined in the Freehold Titles (Conversion) and Government Leases Act, 1963 or under a right of occupancy as defined in the Land Ordinance and any portion of, or any estate or interest in, such land (sect. 2). Provisions of Part II of the Act provide for compulsory acquisition of land for public purposes. Section 4 provides a definition of public purposes. In sections 6 to 10 the procedures of notification of intention of compulsory acquisition are outlined.

    This Act provides rules relative to the survey of land. consists of 49 sections which are divided into 9 Parts: Preliminary (I); Administration (II); Recognition and Duties of Land Surveyors (III); Original Surveys and Re-surveys (IV); Division Surveys (V); Townships (VI); Beacons and Boundaries (VII); General Plans and Diagrams (VIII); Miscellaneous (IX).At Harare a Surveyor-General's Office is established (sect. 7). A Survey Regulations Board is established under section 8. The Board may make Regulations, with approval of the Minister, prescribing matters specified in section 9.

    The text of the Act opens with an extensive interpretation section. It includes definitions of "contiguous", "diagram", "erf", "land surveyor", "owner", "reference mark", and "township". The Minister shall appoint a Chief Surveyor-General (sect. 2). The Chief Surveyor-General shall be in charge of such geodetic, topographical and cadastrial survey and land information services in the republic as the Minister of Agriculture and Land Affairs may direct and shall perform the duties specified in section 3. Offices of the Chief Surveyor-General may be established in the provinces (sect. 4).

    Section 2 empowers the Minister of Land Affairs to delegate any power conferred upon him or her by or under a law regarding land matters to a premier or member of the Executive Council of a Province or any officer contemplated in section 1 of the Local Government Transition Act, 1993. The power delegated shall be exercised subject to directions of the Minister. The Premier or a member of the Executive Council may again delegate the power delegated to him or her to specified local government officials.

    This Act shall not apply to rights and obligations governed by customary law of any person other than the State. This Act shall bind the State (sect. 3). Subject to provisions of Part II and Part V, a person shall by prescription become the owner of a thing which he has possessed openly and as if he were the owner thereof for: (a) an uninterrupted period of thirty years; or (b) a period which, together with any periods for which such thing was so possessed by his predecessors in title, constitutes an uninterrupted period of thirty years.

    This Act concerns the lease of settled estates. "Settled estate" is defined in section 2 as "all immovable property and all estates or interests in any such immovable property, which are subject of any settlement". "Settlement" is defined as "any deed, agreement, will or other instrument under or by virtue of which any immovable property or any estate or any interest in any such immovable property stands limited to or in trust for any person or persons by way of succession or for a life or lives, or for a term of years determinable with the death of any person".

    Persons having acquired a just and lawful right of title in derelict lands, either by prescription or by contract or in any other manner, may apply to the High Court to order the registration of such title (sect. 3). Section 4 provides for the application for the registration of land by persons entitled to "expropriate" such land. Section 5 provides for the application to the high Court for relief by persons having a claim on derelict land.
