   This Decree regulates Land Act No. 19/97 establishing right of use and conditions for exploiting public lands. It consists of 7 Chapters and 1 technical annex specifying different land uses, listing obligations and rights of foreign or national entities, fees to be paid in order to obtain a licence for land exploitation, etc. It concerns requirements to be met for obtaining the aforementioned licence and regulates plans for land exploitation to be sent for approval to the competent authority. Technical Annex specifies requirements to be satisfied and limits (servitudes) of land areas.

   Regulations to make provision for the "regularisation" of land and the drafting and adoption of schemes for this purposes.The 35 regulations are divided into 5 Parts: Preliminary (I); Regularisation Area (II); Scheme of Regularisation (III); Adjudication (IV); Local Land Register (V).The Minister responsible for lands may, under regulation 3, subject to section 58 of the Land Act, or at the request of the people in a given area declare urban areas or "peri-urban areas" to be a regularisation area. Criteria for decision making in this respect are set out in regulation 4.

   Cette loi modifie divers articles de la loi portant régime du domaine privé national. Elle permet aux nationaux malgaches, en attendant de s'établir dans les conditions prévues par la loi, de continuer à jouir des droits d'usage traditionnels (art 54). Les îles ou îlots ne peuvent faire l'objet d'une appropriation privée sous quelque forme que ce soit (art 57). Les litiges relatifs aux droits réels intéressant les immeubles du domaine privé relèvent de la compétence des tribunaux civils (art. 68). L'article 71 bis fixe la réglementation relative aux contraventions.
