This Act lays down rules regarding the acquisition of property rights of agricultural and forestry lands, the institution of usufruct right on such lands, the use of land, the control on restrictions relative to the acquisition of land, and rules regarding local land commissions. This Act applies to all land in the national territory.
The purpose of this Law is the establishment of market oriented conditions in the agricultural sector based on private ownership. Land transfer and the use of land as guarantee for land-based credit should promote the efficient operation of new businesses. This Law basically regulates the use of arable land and aims to create landed properties suitable for competitive agricultural production, avoiding to burden land with the effects of excessive subdivision.
The Act is divided into six Parts as follows: Preamble (1); Ownership (2), divided into the following chapters: General rules (I), State ownership (II), Cooperative ownership (III), Private ownership (IV), Special rules concerning acquisition of land; Use of Land (3), divided into the following chapters: Joint use with a farmers' agricultural cooperative (VII), Indemnification in case of certain rights of use of public interest. Part 4 deals with the exchange of land (X), Land/estate reallocation (XI).
Applications to the Governor, under section 83 of the Act, for the grant of a licence to acquire land in Bermuda shall: (a) in the case of a Commonwealth citizen who is a restricted person, be in the form set out in the First Schedule; and (b) in the case of an alien, or the specially restricted child of an alien, be in the form set out in the Second Schedule, and shall be accompanied by the fee prescribed in the Regulations made under the Government Fees Act 1965; and (c) in any other case, be in the form set out in the Third Schedule, and shall where the beneficiary or any of them is an a

This Act provides for the imposition of an annual levy on land owned by an absentee (as defined by this Act. The levy shall be charged on the unimproved value of the land, i.e. the capital sum that might be expected to be offered for the fee simple with vacant possession of the land at a bona fide sale on such reasonable terms and conditions as a bona fide seller would require, it being assumed that no improvements had been made on or to the parcel of land. The Act allows for objections to be lodged against assessment of value.
This Act amends the Absentee Landowners Levy Act 1976 in Paragraph (1)(a) of section 3. That provision defines, for the purposes of the princiapal Act, an absentee, in relation to a year of levy: (a) a person, not being a company, who: (i) has been absent from Norfolk Island for more than one-half of the year of levy; and defines businesses.
