On July 21, 2011 the then Acting Prime Minister Sam Abal announced the establishment of a Commission of Inquiry to investigate 77 land leases which were issued under the Somare government’s Special Agriculture & Business Leases (SABL). The inquiry, which was later extended by Prime Minister Peter O’Neill in October 2011 for a further five months, discovered that over 90 percent of the leases totalling over 5 million hectares were illegally obtained from traditional landowners (Zealand, 2015).

The Act also replaces section 8 on the validation of decisions of Central Court and Administrator made before the date of commencement of the Nauru Lands Committee Ordinance 1956.

Under section 11, the registrar has to maintain a register called Foreign Ownership of Land Register, the information contained in the register can be accessed by the public upon payment of prescribed fees (sect. 14). Part 3 is dedicated to notification of ownership and of related matters to the registrar. Part 4 is covers offences and penalties and Part 5 contains provisions on forfeiture and restraining orders.
