This Act amends the Constitution of Samoa by repealing Article 41A and by repealing and replacing Article 41. Article 41 concerns the office and powers of the Attorney-General and prosecution of offences. Consequential amendments are made to a number of Acts, including, amongst others, the Land Titles Registration Act 2008, the Waste Management Act 2010, and the Water Resources Management Act 2008.

This Act amends provisions of the Cook Islands Act, 1915 with respect to the alienation of native land. Subsection (2) of section 475 of the principal Act is hereby amended by omitting, the words "the High Commissioner" and substituting the words "an officer of the Land Court approved in writing for the purpose by the Secretary of Justice". Section 482 of the principal Act is hereby amended by repealing subsection (3).

This Act provides for the establishment of Customary Land Advisory Commission. The Commission shall, among other things: (a) recommend to Cabinet suggested measures for the facilitation, encouragement and promotion of the economic use of customary land in Samoa; (b) review all laws affecting customary land in Samoa and make recommendations to Cabinet for changes to such laws where such are necessary for the facilitation, encouragement and promotion of the economic use of customary land.
This Act provides for the continuation of the Development Bank of Samoa as a body corporate, defines its functions and powers and provides with respect to its functioning and operations.The principal functions of the Bank shall be to promote the expansion of the economy of Samoa for the economic and social advancement of the people of Samoa by, among other things: making loans and giving financial, technical, and advisory assistance in its discretion to any enterprises in Samoa; undertaking or participating in infrastructure developments; and entering into partnerships by way of joint ventu
