   This Act concerns the alienation of freehold to foreigners. Sections 4 and 5 define the application sphere of the Act with respect to alienation of land to foreigners. Where any alienation to which this Act applies is entered into, the transaction shall be deemed to be entered into in contravention of this Act, unless an application for the written consent of the Head of State to the transaction is made in writing to the Minister within 3 months after the date of the transaction or within such further time as may be allowed by the Minister.

   The Act provides with respect to the holding of rights in land and mortgages by foreigners in Grenada. It also provides for forfeiture of illegally-held land and shares of companies that do not comply with the provisions of this Act. The Minister may, if he or she thinks fit, from time to time, grant to any alien a licence to hold land as owner or tenant for any estate or interest either subject to any condition (or not) or grant to an alien a licence to hold land as mortgagee for any estate or interest therein.

   All area described in the Schedule hereto is declared a designated area for the purposes of the Aliens Land Holding Act (reg. 2). No alien shall acquire land within the area designated hereunder and no legal or equitable title in such land shall vest in an alien unless such alien shall have first applied for and been granted a licence by the Minister to acquire and to hold an estate in such land (reg. 3).    The Act amends the Aliens Landholding Regulation Act by inserting a new section 5A on obligations of aliens who acquire land under section 5. On acquiring land, under section 5 for an approved development the alien shall - (a) make an application for development permission under the Physical Planning Act, 2002 within six months of acquiring the land; and (b) commence construction of the approved development within one year of receipt of development permission under the Physical Planning Act, 2002.

   Under section 1 of this Act, every alien has the same capacity to take by gift, conveyance, descent, devise, or otherwise, and to hold, possess, enjoy, claim, recover, convey, devise, impart and transmit real estate in Ontario as a natural born or a naturalized subject of Her Majesty.

   These Amendments concern the Law on the Ownership and Use of Farmland. The Law regulates the ownership and use of agricultural lands. Agricultural lands may be the property of citizens, state, townships and juridical persons. Foreign juridical persons and foreign citizens may acquire use rights to agricultural land. There are also provisions relating to owners of land incorporated into cooperative farms. The ownership right to agricultural land taken away from the Bulgarian Orthodox Church, cooperatives and other organizations shall be restored upon their request.

    This Act amends the Penal Law so as to introduce measures against unauthorized possession or occupation of land and criminal conveyance of land. “Criminal conveyance” means the conveyance through sale, donation or lease of land by a person who has no title to do so. The Act defines offenses relating to criminal conveyance of land and prescribes penalties for such offences. The Act also defines affirmative defense.
