Publicación revisada por paresNoviembre, 2014Malawi, Noruega, Estados Unidos de AméricaBased on government statistics and interviews with villagers across Malawi this article argues that customary matrilineal and patrilineal land tenure systems serve to weaken security of land tenure for some family members as well as obstructing the creation of gender-neutral inheritance of lands. Data from the National Census of Agriculture and Livestock 2007and the 2008 Population and Housing Census are used to characterize marriage systems and landholding patterns of local communities. Marriage systems correspond to customary land-tenure patterns of matrilineal or patrilineal cultures.

It aims to inform current and future design and implementation of programs that promote land-based investment and land rights (particularly women’s land rights) by civil society organizations, other donors, and the private sector.

The methodology used relied first on context analysis of the critical aspects influencing and hindering women´s land rights.

The glaring disparity is made clear when looked at against the actual land sizes and titled for women against men. The data sample shows that out of 10,129,704 hectares of land titled between 2013 and 2017 women got 163,253 hectares representing a paltry 1.62 while men got 9,903,304 hectares representing 97.76 percent.

This considering the fact that, in Kenya where the foundation of most communities is Agriculture and livestock production, women contribute up to 80% of workforce yet they only hold 1% of registered land in their names and around 5-6% of registered titles are held in joint names (Kenya Land Alliance, 2013).
