   This Ministerial Decree establishes the modalities of carrying out tenders for allocation of plots of public land in recreational and health resort area in Issyk-Kul province for construction of health resort facilities, objects of tourism and service. State administration shall be granted the right to concede the aforesaid plots of public land for aforesaid purposes with the consideration of restrictions imposed by the national legislation. The plots of land must be free of abridgement of rights related to third party.

   This Ministerial Decree establishes the modalities, terms and conditions of concession of right of ownership or lease of urban land for payment related to public and municipal land. Concession of urban land in ownership can be carried out through direct sale of land. The provisions of this Decree shall not be applicable to concession of the plots of land free of charge.

   This Ministerial Decree establishes the rules for state registration of rights and encumbrances to immovable property and transactions therewith. The following rights and encumbrances shall be subject to mandatory state registration: (a) ownership; (b) tenancy; (c) mortgage and encumbrances originating therefrom; (d) lease and sub-lease for the period of three years and over; (e) servitude; (f) use restrictions; (g) court decisions; (h) nature management activities listed by the Government; and (i) open-ended land tenure.

   This Ministerial Decree regulates purchase and sale of agricultural land pertaining to public and private ownership. Purchase and sale of the plots of land shall be carried by owners otherwise it can be carried out by third party in accordance with notarized letter of authority. Sale of agricultural land polluted with chemicals and radioactive substances exceeding maximum allowed limits shall be prohibited. Purposeful use of agricultural land after transaction shall be preserved along with existing servitude.

   This Instruction shall be applicable to concession of land located in the protected area of Issyk Kul for construction of health resorts, rehabilitation, recreational and tourist sites. Temporary concession of land for the aforesaid purposes shall be carried out exclusively through open tenders. Each plot of land shall be put on sale as a separate lot. Boundaries of the plot of land put on sale shall be coordinated with adjacent land tenants and landowners.

   Item 2 shall be amended to add the following wording: "Cadastre valuation shall be applicable for the purpose of assessment of cost of forest land either pertaining or not pertaining to public forest in case of management thereof for purposes not related to forest manegement, and also for expropriation (purchase) for state and public needs".
