   The Act establishes that the right to administer soil, water and air is vested in the State. The State, therefore, has the authority to: (a) regulate the allotment, use, supply and maintenance of soil, water and air; (b) regulate the legal relations between persons and soil, water and air; (c) regulate the legal relations between persons and legal acts concerning soil, water and air. The exploitation of these resources both by individuals or corporate bodies is to be performed within the objective of the national interest and by guaranteeing the protection of economically-weak groups.

   The purposes of the present Act are to enable the Sechelt Indian Band to establish and maintain self-government for itself and its members on Sechelt lands and to obtain control over and the administration of the resources and services available to its members. Section 5 establishes that the Sechelt Indian Band is hereby established to replace the Indian Act Sechelt Band.

   The present Act is a piece of companion legislation to the Federal Sechelt Indian Band Self-Government Act and provides for provincial recognition of the Sechelt Indian Government District. The ministry is responsible for section 4, which makes the district eligible for municipal benefits.    The present Act is made under the James Bay and Northern Quebec Agreement. In particular, the Act deals with Category IA and Category IA-N native lands and their local administration. Category IA lands are those that were transferred from the Province of Quebec to the Government of Canada for the exclusive use and profit of the Cree bands in the James Bay region.

   This Act, consisting of 243 sections divided into fourteen Parts and completed by twenty-eight Schedules, provides for the consolidation of the law relating to the simplification of the title to and the dealing with estates in land in Western Australia. This Act does not apply to the registration of rights over land in respect of minerals, petroleum, geothermal energy or geothermal energy resources; or prevent or otherwise affect the system of registration under other Acts of mining, petroleum or geothermal energy rights in respect of land whether Crown, freehold or leasehold.
