Article 9 (1) shall be amended to add the following wording: “The procedure for establishment of historical and cultural value of an object of cultural heritage shall include the following: (a) examination of information and data related to the object; (b) establishment of historical and cultural value of the object; and (c) decision-making on inclusion of the object in the list of objects of historical and cultural heritage of rejection of such inclusion”.

This Regional Law establishes the modalities of organization and performance of public control as a form of public participation. It shall not be applicable to elections and referendum. Regional executive bodies shall have the following plenary powers: (a) formation of advisory councils at the regional executive bodies; (b) examination of final documents drafted by public control bodies; and (c) consideration of proposals, recommendations and conclusions contained in the final documents.

The scope of this Regional Law shall be to ensure fertility of agricultural land by owners, landlords, land tenants and leaseholders. The main arrangements for ensuring soil fertility shall be: (a) elaboration and realization of regional programs; (b) soil, agrochemical, phytosanitary, ecological and toxicological inspection; (c) investments in soil conservation and reproduction; and (d) improvement of soil quality and fertility.

This Law regulates relations in the sphere of identification, conservation, management, promotion, public protection, import and export of the objects of cultural heritage thus ensuring the right of Turkmen people to conservation and development of its national identity. Objects of historical and cultural heritage shall be considered those created fifty and more years ago. The Cabinet of Ministers shall set forth rules and regulations concerning ownership, management and disposal of the object of historical and cultural heritage.

The scope of this Regional Law shall be to set forth the conditions for the breeding, keeping and protection of bees, and also for protecting legal rights and interests of natural and legal persons carrying out apiculture. This Regional Law establishes the modalities of performance of municipal land control by local government. Municipal land control shall be conducted in the form of ordinary and extraordinary inspections of legal persona and individual entrepreneurs. The subject of inspection shall be checking data and information contained in the documentation related to land tenure. The scope of inspection shall be to control compliance by land tenant with compulsory legislative requirements related to land tenure. Municipal land control shall be performed in accordance with the annual plans.

Article 72 of Land Code shall be amended to add the following wording: “Agricultural land plots of dimensions within 5 ha shall be indivisible. Agricultural land plots of dimensions over 5 ha can be split in separate land plots for the dimensions exceeding 5 ha on condition that the dimension of new separated land plots shall not be less than 5 ha”. Article 15 of Law No. 4 on management of agricultural land shall be amended to add the following wording: “Owner of agricultural land share shall have the right to sell it without payment of state duty.

This Federal Law establishes the right of tenants of agricultural land plots pertaining to state or municipal ownership to buy out or to conclude a new lease contract for the land plot without bidding. This is possible if the authorized bodies do not have information about the infringement of the Russian legislation revealed during the state land supervision and unresolved violations related to land use.
