   The senior matai in charge of communal lands belonging to his family, or the male members of the family owning and residing on communal lands, or the owner of individually owned lands or freehold lands, shall have the power and authority, as limited by this Chapter, to agree with any person that any structure now existing or hereinafter erected on such lands shall not be or become a part of the real estate, but shall remain separate and distinct therefrom, subject to ownership separate from the land, and also subject to the right of removal by the owner of the structure.

   This Chapter makes provision for the expropriation of land in American Samoa by the Government for public purposes and for lease of public lands. Where possible, the Governor shall consult with the Legislature about proposed condemnation projects, and shall obtain the advice of the Legislature on all such projects. Compensation shall be paid. Land not used for the stated public purpose within five years of condemnation shall be returned to the owner.

   This Act makes provision for various matters in relation with the government of Tonga including the Cabinet, the Privy Council, the Legislative Assembly, Ministers and local authorities.The Minister of Lands shall be the representative of the Crown in all matters concerning the land of Tonga. Any District Officer may make Regulations for the administration of village plantations and other necessary matters relating to the welfare of the people of his village. Such Regulations shall be valid only if sanctioned by the Cabinet.

   This Ordinance concerns probate of will of a deceased person and the administration of deceased persons granted to an administrator by or without a will. Assets and liabilities of a deceased person shall be determined by the Supreme Court. The Court shall notify executors on probate of will and shall issue probate or letters of administration in accordance with provisions of this Ordinance. Unclaimed estate shall become property of the Crown. The Ordinance also provides for the division of intestate estates.

   This Act regulates various matters relating to deeds of heritage. Property which may be disposed of by will is defined in section 3. Other matters covered are: wills of minors; form of will; manner of revocation of will, alteration in a will after execution; revival of revoked will; general devise of land to include leasehold as well as freehold land; devise of real estate without any words of limitation; execution of wills made abroad.

Part III sets out the general powers of trustees including lease and sale of property. Part V concerns the appointment of new trustees, vesting orders, and other powers of court such as the power of Court to authorize dealings with trust property and variations of trust and the power of Court to direct sale or lease.    The Act consists of 46 sections divided into 7 Parts: Preliminary (I); Administration (II); Acquisition of land (III); Grant of licences (IV); Compensation (V); Regulations (VI); Miscellaneous provisions (VII).There shall be a Chief Mining Inspector, a Mining Office and Mining Inspectors. The Mining Office shall be under the control of the Chief Mining Inspector. Duties and powers of Mining Inspectors are set out in sections 6 to 8.

    An Act to regulate the practice of land valuations by the registration and licensing of qualified land valuers and the prescription of requirements for land valuations and the application of a formula valuation system, and for related purposes.

    This Act provides rules for the valuation of land by land valuers registered and licensed under this Act. It also defines the functions of the Ministry responsible for lands for purposes of this Act and establishes the Land Professionals Registration Committee (Land Valuation). The Committee shall, among other things, promote and maintain high standards of professional education and conduct among persons engaged in the practice of land valuing in Samoa and act as a disciplinary body. The Act shall be administered by the Ministry of Natural Resources and Environment.
