   La presente Ley tiene como finalidad la protección, el fomento y el desarrollo de las comunidades indígenas. El título II (arts. 12-22) se ocupa de manera particular del reconocimiento y protección de las tierras indígenas. A efectos de esta Ley son tierras indígenas aquellas que las personas o comunidades indígenas actualmente ocupan en propiedad o posesión históricamente, o bien en virtud de los títulos indicados en el artículo 12, así como las que los indígenas o sus comunidades reciban a título gratuito del Estado.

   The State Treasury validates amendments and additions No. 4 to the Regulation of the State Treasury No. 29 of 1995 regarding the application of the Law "On royalties for the use of land" according to the Annex. This document has been previously approved by the Ministry of Finance and by the State Committee on Land Resources and Land Survey. Regulation 1 is modified as follows: paragraph 5 is supplemented with point 25.

   This Order regards Articles 5 and 26 of the Law "On royalties for the use of land". Paragraph 5, point 4 acquires a new wording. It reads as follows: "Ministerial Decree No. 1108 of 1993 regarding specially authorized bodies of wildlife protection and regulation establishes that the Ministry of Agriculture (the Department on protection and rational use of the wildlife species and its territorial branches) and other specially authorized bodies represent specially authorized bodies of wildlife protection and regulation".

   This Ordinance of the Governor of Sint Maarten provides rules relative to matters of inheritance. It replaces completely book 4 and title 3 of Book 7 of the Civil Code. It concerns inheritance based on will an intestate. Various provisions concern rights in land, including usufruct and lease of land. Donation shall be effected by notarial deed.

   This Act provides rules relative to sale and other transactions concerning land. It also concerns (statutory) mortgages, easements and selected matters regarding leases. The Act requires contracts for sale etc. to be in writing. All conveyances of land or of any interest therein are void for the purpose of conveying or creating a legal estate unless made by deed. The Act specifies covenants that may be included in a deed. Mortgaged land may be leased by mortgagee or mortgagor for agricultural or mining purposes. As for mortgages the Act specifies procedures for execution.

It shall apply to the administration of estates of all persons dying domiciled, or leaving property, in Malawi on or after the date upon which the Act comes into operation; but any property belonging to the estate of such persons which, at the coming into operation of this Act, remains partly or wholly undistributed, shall be distributed in accordance with the provisions of this Act.

    This Act provides for the grant by the Government of perpetual leases, i.e. leases of State land granted for the purposes of land settlement, which shall endure in perpetuity unless they lapse or are terminated or surrendered. Perpetual leases of State land may be granted for purposes of land settlement and shall be subject to terms and conditions stated in them and in provisions of this Act. Transfer, mortgage, etc. of a lease shall be subject to permission of the Government.
