   The aim of this Legislative Decree is to regulate the appropriation of land by foreigners. The present Decree is composed of 5 articles. Article 1 allows foreigners to appropriate lands in the Kingdom of Bahrain according to requirements and conditions which should be issued by the Council of Ministries. Article 2 defines the conditions and requirements for the appropriation of lands by foreign juridical persons. Articles 3-5 contain general provisions.

   This Legislative Decree allows citizens of the Cooperation Council of Arab Gulf Countries to appropriate land in the Kingdom of Bahrain with the same rights of Bahraini citizens. All preceding laws related to the appropriation of lands by citizens of Cooperation Council of Arab Gulf Countries are now abrogated.

   The aim of this Resolution is to regulate the appropriation of lands by foreigners. The present Resolution is composed of 5 articles. Article 1 defines the zones and areas in which foreigners (physical or juridical persons) can appropriate lands in the Kingdom of Bahrain. Articles 2 and 3 specify the conditions and requirements for the appropriation of lands by foreigners.

   This Resolution amends article 1 of Resolution No. 43 of 2003 as follows: “allowing non Bahraini citizens, whether physical person or juridical person, to appropriate land and houses in zones A, B and C of the Kingdom as well as to appropriate tourist and investment projects after the approval of the Ministerial Committee for Public Facilities”.

   Amends: Resolution No. 43 of 2003 on the appropriation of lands by foreigners. (2003-08-11)

   These Regulations add to the list of qualified persons under Section 45, Land Act, 1965, nationals of Member States of the European exercising the right of establishment under Article 52 of the EEC Treaty. Section 45 places restrictions on vesting of interests in land not situated in a county borough, borough, urban district or town. It prescribes that no interest in land to which section 45 applies shall become vested in a person who is not a qualified person except with the written consent of the Land Commission and subject to any conditions attached to the consent.

   These Regulations provide for exemption from the provisions of section 45, Land Act, 1965, the beneficiaries of the five Directives of the European Communities on certain rights of establishment on land so as to implement these Directives on accession of Ireland to the European Communities.    These Regulations add to the list of qualified persons under section 45 of the Land Act, 1965, persons whose principal place of residence is in a Member State of the European Communities or other European State which is a contracting party to the European Economic Area Agreement and bodies corporate incorporated, having their registered office, central administration or principal place of business in those States. Section 45 places restrictions on vesting of interests in land not situate in a county borough, borough, urban district or town.

   This Act provides rules relative to the holding of land in Antigua and Barbuda by a person who is not a citizen of Antigua and Barbuda.“Non-citizen” is defined by the Act. No land or mortgage on land shall be held by unlicensed non-citizens but land may be acquired under a lease not exceeding more than five years. Licences to hold land or a mortgage in land shall be granted by the Governor-General. Land that is held in an unlawful manner shall be forfeited.

    This Act formulates a duty of non-citizens to develop land held in ownership, grants powers to the Minister to declare land held by non-citizens to be underdeveloped land and imposes an annual tax on the value of such underdeveloped land.In determining whether a non-citizen is fulfilling his or her responsibility under the Act to develop agricultural land, regard shall be had to the extent to which and the manner in which: (i) pasture is being maintained; (ii) arable land is being cropped; and (iii) the land is stocked where it is being used for livestock farming.
