    The study is reported in two Working Papers. Working Paper 17 reports the findings of the HIM exercise. This paper contains the policies, legislation and organizations relevant for understanding of the HIM for the Olifants river basin. It also includes the historical development of the institutional framework in the basin, as this history has left a profound imprint on the South African society at large and is still dictating, in many cases, the interactions between the different organizations.

    We believe that law should in principle assist vulnerable communities in changing power relations. Law is fundamentally a ‘neutral’ set of rules that constrains power by requiring decisions and actions of those in power to comply with legal rules, rights and obligations. Unfortunately, we have seen the powerful appropriate law as a tool for only protecting and strengthening their interests.

    Land-use conflict is not a new phenomenon for pastoralists and farmers in Tanzania with murders, the killing of livestock and the loss of property as a consequence of this conflict featuring in the news for many years now. Various actors, including civil society organisations, have tried to address farmer–pastoralist conflict through mass education programmes, land-use planning, policy reforms and the development of community institutions. However, these efforts have not succeeded in the conflict. Elsewhere in sub-Saharan Africa traditional systems are not making much headway either.

    Property rights are a cornerstone of economic development and social justice. One of the most fundamental ways of understanding the strength of property rights is through citizens’ perceptions of them. Yet perceptions of tenure security have never been collected at a global scale, obscuring a clear understanding of the magnitude and nature of citizens’ experience, and preventing the issue of property rights from receiving the visibility and attention it deserves. The Global Property Rights Index, or PRIndex, seeks to address this gap.
