This paper explores the politics of ‘customary’ land tenure, land reform, and traditional leaders in Zambia. In Zambia, as elsewhere in Southern Africa, the government at the behest of donors has implemented market-based tenure reform legislation. This legislation aims to improve the security of land tenure and to promote development through investment. The paper shows how complex, indeterminate, and contentious this tenure reform has been on the ground – particularly in relation to the 94 per cent of Zambian land that is held in ‘customary’ tenure.

Ill-regulated land acquisition and unilateral land concessions may often trigger forced relocations, conflicts and human rights abuses. This course introduces the concept of Free, Prior and Informed Consent that indigenous people and small family farmers can use to protect their customary or traditional land rights. The process ensures that communities can participate in decision-making processes and that their concerns, priorities and preferences are accommodated in any project affecting their lands, territories and resources.

The oil palm boom in Southeast Asia has increased demand for institutional arrangements facilitating large-scale plantation development on customary lands. A financial model of an oil palm plantation in Sarawak, Malaysia, is used to explore six project types, including managed smallholders, three different joint-venture arrangements, renting, and (for comparison) a private plantation on state land. Benefit-cost analysis is used as basis for project, private (shareholder), and stakeholder analyses.

Studies draw attention to gender inequalities in land tenure. While some insist that gender inequalities in land tenure exists others do not. This paper discusses a study that examined gender issues in customary land ownership in the Wa Municipality. It sought to understand and find ways of bridging the gender gaps, if any. A survey covering 151 respondents comprising Chiefs, Tendamba, women and family heads was undertaken. The research revealed significant disparities between men and women regarding access to and ownership of land.
