   This Act amends Sections 16 and 17 regarding, respectively, rights and facts to be recorded in the real estate register. Section 26 of the Basic Text on the commencement of registration proceedings is also amended. Section 32 of the Basic text regarding the contents of documents valid for the purpose of real estate registration is replaced. This Act adds a new Section 52/A to the Basic Text on the delivery of resolutions on the registration of data, rights and facts.

   The Act sets regulations concerning cadastral designation and registration. If a cadastral property is registered as a farming property, it will include added agricultural areas as well. The cadastral regulating authority is the Danish Geodata Agency.

In order to fulfill this capacity, a person must be of legal age, is not under bankruptcy, has passed the Danish surveyor exam and has at least 3 years’ experience following the surveying exam, and has participated in the commonly occurring cadastral works by recruitment from a practicing surveyor – either by Survey and Cadastre Authority of the Jutland department or cadastral authority in Copenhagen and Frederiksberg Municipality.

   This Act sets out the conditions and procedures for the partition of land held by more than one tenant.The partition of the co-owned land shall be made on the basis of a current state of occupation by each co-owner. The Act provides for the establishment of the Co-owned Land Partition Committee and for its composition and functions. The Committee shall make a fair deliberation and resolution on the matters concerning partitions of co-owned land.

    The purpose of this Act is to establish a real estate transaction order by providing matters pertaining to special cases relating to real estate registration. Provisions for applying for registration of transfer of property are defined in article 2. To apply for an ownership transfer registration for a contract to purchase real estate the applicant shall submit a contract containing items specified in article 3. Special cases pertaining to applications of seals of approval and to permission are defined in articles 4 and 5.
