   This Act provides for mining, including alluvial mining, and regulates in detail various aspects of mining tenements, i.e. (a) an exploration licence; (b) a special mining lease; (c) a mining lease; (d) an alluvial mining lease; (e) a lease for mining purposes; and (f) a mining easement, granted or deemed to have been granted under this Act.A tenement granted under this Act is not an interest in land for the purposes of the Land Act 1996 (sect. 2). The Head of State may grant a special mining lease on specific terms and conditions under section 33.

   This Act establishes the land Titles Commission as an independent judicial tribunal for the resolution of disputes of rights in land, including an interest in land, whether arising out of and regulated by custom or otherwise, provides for judicial procedures and the extra-judicial settlement of disputes and some other matters. The Land Titles Commission for Papua New Guinea is established under section 3. The Chief Commissioner is responsible for the administration of the Commission and the co-ordination of the work of the Commissioners.

   The Minister may declare a port or any waters of Papua New Guinea and any land contiguous to such waters, to be a declared port for the purposes of this Act. The Papua New Guinea Harbours Board is established under section 3. The Board shall give effect to any direction given to it by the Minister on any matter of policy relating to the exercise or performance of its functions, duties or powers. The Board shall be responsible for the regulation, management, operation and control of declared ports.

   This Act regulates some aspects of the (non) contractual relationship between landlord and tenant such as compensation for use and occupation in case of land held not by written agreement (deed), no obligation of attornment by the lessee under the lease in case of a conveyance of the reversion or remainder expectant or depending on a lease of any land, attornment by a lessee to a third party without consent of the lessor, rent, obligation of lessors' covenants and rent and benefit of lessees' covenants.

The Mining Office shall be under the control of the Chief Mining Inspector. Duties and powers of Mining Inspectors are set out in sections 6 to 8.

   Expropriation for Public Utility Act [Cap 36].

   An Act to provide for the expropriation of immovable property for the purposes of public utility.

   This Act provides for the acquisition of land or rights in land for public purposes. Expropriation of immovable property for the purposes of public utility shall be effected by order of the Supreme Court, which shall only make an order of expropriation when the procedure laid down by this Act has been complied with. Expropriation may be ordered only after the Minister responsible for public works has by Order declared the transaction of public utility and other procedures set out in sections 4 to 12 are carried out.

    This Act provides for the establishment of Village Courts, defines their functions and jurisdiction and defines the relationship between village courts and other courts.The Minister may, by Notice in the National Gazette, establish a Village Court in and for an area specified in the Notice. A Village Court shall be constituted by Village Magistrates. The Village Courts shall have a well-defined civil jurisdiction in respect of disputes regarding land. The Village Courts shall also have specified criminal jurisdiction.
