   Est adoptée la politique nationale de sécurisation foncière en milieu rural du Burkina faso dont le texte est joint en annexe au présent décret. La sécurisation foncière des acteurs ruraux est une condition incontournable pour un développement économique et social durable. Pour apporter des réponses efficaces et durables au problème de la sécurisation foncière des acteurs ruraux, le gouvernement du Burkina Faso a décidé d’entreprendre l’élaboration d’un document de politique nationale de sécurisation foncière en milieu rural (PNSFMR).

   This Legislative Decree, composed of 50 Chapters, approves the basic Order on Urban and Spatial Planning. In particular, it provides a classification of land comprised under the national territory and defines the basic principles undergoing spatial planning and management. Particular attention is paid to the institution of an integrated management system involving national and local administrations, as well as the provision of framework contracts as urban planning tools.

   This Law, composed of 89 articles divided in 5 chapters, regulates the general principles on land rights.    This Decree-Law, composed of 39 articles, rules on State’s withdrawal from the management of production units. To this end, it stipulates that the Government shall implement development programmes, as well as define the guidelines for the zoning of the production units to be assigned. The Decree-Law indicates the procedures for State withdrawal, the applicable concession regime, the forbidden property concessions, and the admitted applicants.

   Le présent décret porte application de l'article 5 de la loi nº 64-46 relative au domaine national, et fixe les conditions de l'administration des terres du domaine national à vocation agricole situées dans les zones urbaines. A l'intérieur des zones urbaines, des sections rurales peuvent être créées par décret, dans les secteurs non urbanisés et qui ne doivent pas faire l'objet d'une urbanisation dans un délai rapproché.

    The Regulation is made under the Land Proclamation No. 58/1994. It sets out the procedure for the allocation and administration of land and applies to all types of urban and rural land. Land shall be allocated for tiesa, agricultural usufruct or leasehold, on the basis of a master plan. To ensure these rights, right holders shall be given an allocation certificate or lease agreement. To prevent allocation of land to holders with the sole aim of holding land idle, the size of land to be allocated shall be proportionate to the planned aim (art. 3(4)).
