This Proclamation aims at improving management and utilization of land and land resources for agricultural purposes in the Southern Nations, Nationalities And Peoples' Regional State. It applies to all land that lies outside of municipal borders. The Proclamation defines the right to acquire, free of charge, rural land by peasants, pastoralists and semi-pastoralists engaged in agriculture and the equal rights of women with respect to land and provides for the protection of such rights.

This National Land Policy will guide the country towards efficient, sustainable and equitable use of land for prosperity and posterity. The Mission of the Policy aims at: promoting positive land reforms for the improvement of the livelihoods of Kenyans through the establishment of accountable and transparent laws, institutions and systems dealing with land (sec. 1.3). This Proclamation of the Benishangul Gumz Regional State shall apply to any rural land found in the region. It mainly is concerned with land rights land use and administration of rural lands. Land is declared the common property of the state and people and it shall not be subjected to sale or other means of exchange. Any peasant who legally resides in the region shall have the right to hold land irrespective of gender or any other discrimination. Land administration shall be implemented through community participation. Rural land shall not be expropriated unless to use for public services.

This Decree by the Council of Ministers makes minor amendments in Article 1 of the Decree No 2009/15173 by changing the name of the ‘Ministry of Agriculture and Rural Affairs’ to the ‘Ministry of Food Agriculture and Livestock’. The Decree further makes changes in the annex 2, 4, 5, 6, 11, 12, 14, 16, 19, 20, 22, 24, 25 and 29 providing for the designated regions of agricultural lands.
