    This Ordinance provides for the constitution of the Lands Court, defines its jurisdiction, functions and duties and provides with respect to the Land Register and other matters such as offences and regulation-making powers of the Governor.The Lands Court shall, among other things: exercise supervisory jurisdiction over all lands on Pitcairn Island; cause land to be demarcated and a Register of Lands to be kept; determine on applications for land allocation in accordance with this Ordinance and the Land Tenure Reform Ordinance; and hear disputes relative to ownership of land on Pitcairn Isla

    This Act makes provision for procedures in relation with the alienation of public land through lease or sale. The Land Board may by public notice call for applications from the public for any Government land available for alienation by way of lease or sale under the principal Act. Where the Board has determined that certain Government lands are available for alienation by way of sale it shall first obtain the approval of Cabinet for the alienation by way of sale of such lands. Lands shall be sold by tenders for which procedures are set out.

    This Act amends the Lands, Surveys and Environment Act 1989 with respect to (appointment of) authorised officers for purposes of the principal Act. The Chief Executive Officer may appoint officers or employees of the Ministry or other persons, as authorised officers for the purposes of this Act. An enforcement officer of the Land Transport Authority shall be treated as authorised officer. This Act also provides that all references to “Conservation Officer” under the principal Act or any other enactment are amended to “authorised officer”.

    This Act amends the Lands, Surveys and Environment Act 1989 with respect to grant a lease of government land and allotment of such land without competition. It also concerns consent by the Land Board to dealings with leases. The Board shall not consent to a mortgage except for the erection of a dwelling on the land or to increase the production thereof or for the purchase of any unit estate under the Unit Titles Act 2009. Consequential amendments are made to section 23 of the Survey Act 2010.

The Act also defines powers of the Attorney-General in relation to applied law.Customary law comprises the customs and usages, existing from time to time, of the natives of Tuvalu. Schedule 1 to this Act has effect with respect to the determination and recognition of customary law.

    The Act restricts leases, assignment of leases or subleases. Any such lease requires the approval of the Leases Approval Committee, established in the Act. In considering applications for approval, the Committee shall have regard to any criteria as well as policy directions from the Minister of Justice. Approval is not required for leases under the Short Term Crop Leases Act or any lease for a term not exceeding five years. It further provides for application, procedures of the Committee, regulations.

    This Act established the Leases Approval Tribunal and amends the principal Act accordingly in section 3 (approval of Leases Approval Tribunal required for leases) and section 10 (dispute resolution). Section 9A empowers the Tribunal to consider an application to approve a lease that has not been executed by every party to the lease, but only if the Registrar of the High Court notifies the Tribunal in writing that he or she believes that the lease should be approved.
