    This Act concerns the registration of land surveyors and for this purpose establishes the Board of Land Surveyors Examiners. The Board shall keep a Register of Land Surveyors. The Act prohibits surveying of land unless a person is registered as a land surveyor and specifies criteria for registration. The Act also provides for control of the practice of land surveying and defines sanctions for malpractice.

    An Act to Provide for a Land Commission in Rotuma, the registration and dealing with and transmission of land and matters incidental thereto.

    This Act provides for various aspects relative to dealings in land in Rotuma and provides for the appointment of the Rotuma Lands Commission. The Commission shall ascertain (traditional) land rights, resolve disputes relative to land rights, demarcate land and register land rights (sect. 4). All land found by the Commission to be un-owned shall vest in the Crown in trust for the Rotuman people, but shall not be considered to be Crown land. All moneys derived from such un-owned land shall be paid into the Rotuman Development Fund and be used for the purposes of that Fund.

    A trust of any interest in real property may be created to secure the performance of an obligation or the payment of any debt. The encumbrance of real property interests to secure obligations may be by deed of trust pursuant to the provisions of this Act. A transfer does not entitle the trustee or beneficiary to the possession of the property, except as provided in this Act. A deed of trust shall be created, renewed, modified or extended only in writing and must be registered with the Clerk of the High Court. Section 5 prescribes the procedure of registration.

    This Act shall apply to any agreement, regardless of its form, which is intended to give rights in personal property, including houses on land not owned individually or entirely by the party or parties purporting to give an interest in the house, as security for the performance of any obligation. Such Agreements include, among others, pledges, conditional sales agreements, chattel mortgages, and leases under which ownership of personal property is to pass upon completion of the terms of the lease.

The Department of Land Management shall have authority of all government real property for purposes of this Chapter. The Director of Land Management may, when necessary, reserve or set aside government real property not reserved by law for specific public use for the future use of any other department or agency of the government pursuant to section 5.

    This Chapter defines certain matters relative to the recording of land. Any instrument or judgment affecting the title to or possession of real property may be recorded under this Chapter, provided, however, that deeds or grants conveying to a governmental agency, real estate, or any interest therein, or easements thereon, for public purposes shall not be accepted for recordation without the consent of the grantee evidenced by its acceptance attached to such deed or grant. Instruments and judgments to be recorded pursuant to this section shall be recorded by Department of Land Management.

    This Chapter provides for various matters regarding the Chamorro Land Trust Commission, for the grant of leases to a native Chamorros and relates matters and provides for loans for the development of Chanorro communities and lands and for the establishment of various Funds for these purposes. There is within the government of Guam the Chamorro Land Trust Commission. The Commission shall grant leases and otherwise be responsible for the development of Chamorro lands.
