    This Act provides rules for acquisition land in the public interest, including compulsory acquisition, and related matters such as claims to compensation, examination of land and the taking possession of land, registration of interest in land and (effects of) withdrawal from acquisition. Where the Minister is of the opinion that it is necessary to acquire any land in the public interest and that there is reasonable justification for causing any hardship to any person who has an interest in the land, the Minister may acquire that land in accordance with this Act.

    This Act provides for acquisition of lands by the Government for public purposes. No land shall be acquired by the Government: (a) unless the acquisition of the land or the purpose for which it is to be acquired has been expressly authorized by the Legislature (except for construction of roads). The acquisition of land by the Government shall be by means of purchase by agreement or by means of compulsory purchase as provided for in this Act. It consists of 51 sections (grouped into 6 Parts) and completed by two Schedules. Part 2 defines which are the purposes for which land may be taken, the procedures for notification and objections and the means by which land may be taken. Part 3 deals with the discontinuance of taking land, Part 4 with compensation while Part 5 and 6 deal with general and transitional matters.

    This Act empowers the Minister to declare any land settlement scheme to be a public work under section 3 of the Acquisition of Land for Public Purposes Act. A land settlement scheme is defined as including any project intended to secure land for the establishment of farmers as an organized settlement or for distribution by sale, lease or otherwise to persons individually for agricultural purposes. The Act further provides for (assessment of) compensation, power to acquire land by lease.

    This Act regulates the use of farm equipment, i.e. any movables used for agricultural purposes on any agricultural land acquired for resettlement purposes under the Land Reform Programme, and provides for the control of use of farm equipment. Section 3 prohibits wilful destruction of farm equipment without the permission in writing of the acquiring authority (sect. 2).

    An Ordinance to consolidate and amend the law relating to acquisition and requisition of immovable property.

    The Ordinance provides for the acquisition and requisition of immovable property to be destined to public purposes in the public interest. Acquisition shall be communicated by means of a notice affixed in convenient locations in order to inform of the intent of acquiring that property. Requisition for a limited period of time may be exercised by the appointed Deputy Commissioner, following Government’s approval, while no approval shall be necessary in case of an emergency. No property shall be kept in requisition for a period longer than two years.
