   A Law to abolish any rule of customary law providing for the annulment of contracts for the transfer of immovable property on the death of the transferor within 40 days of the passing of the contract.

   This Law abolishes any rule of customary law affirming that a contract passed before the Royal Court for the transfer of immovable property may be annulled, at the instance of the heirs or devisees, as the case may be, of the transferor, if he or she dies within 40 days of the passing of the contract.

   This Act makes provision with respect to matters of inheritance. It provides rules for the making and execution of wills and defines criteria for a will to be considered valid. A person may by will dispose of a contingent, executory or future interest in real property. Wills may be deposited with the Registrar of Probates and Administration.

   This Act makes provision for the registration of title in land and defines effects of registration of title. The Act also provides other rules relative to dealings in land. Land in respect of which title has been registered under this Act may not be transferred, mortgaged, leased or otherwise dealt with, and an instrument that purports to deal with such land shall not be registered, except in accordance with this Act. Rights in land shall be registered with the Registrar of Titles of Norfolk Island.

It provides rules relative to: realization of security, remedies upon failure of performance of any covenant in a mortgage, issue of special certificate of title to mortgagor by the Registrar and fixing of mortgage rates by the Minister.
