    An Act to amend the Land Act.

    Section 140 of the Principal Act is deleted and replaced with the following: "(1) Any party may, upon payment of the prescribed fee, appeal from any order or judgment of the Court: (a) if the order or judgment relates to the determination of hereditary estates or titles, to the Privy Council pursuant to Clause 50 of the Constitution; (b) in every other case, to the Court of Appeal. Any such appeal shall be made in such manner as may be prescribed by rules of court within 42 days of the date of the order or judgment appealed.

    An Act to make provisions relating to the issue of exploration licence and petroleum agreement with regard to exploration, prospecting and mining for petroleum in the Kingdom of Tonga and to provide for matters connected therewith.

    Section 3 prescribes that no person shall explore, prospect or mine for petroleum except by virtue of an exploration licence or a petroleum agreement issued or entered into the provisions of this Act. Any person desirous of exploring, prospecting or mining for petroleum may apply to His Majesty in Council for an exploration licence or a petroleum agreement in respect of any area of land. Section 5 sets out the manner in which application may be made. His Majesty in Council may issue in respect of the same area of land more than one exploration licence.

    An Ordinance to provide for title and registration of rights in native land.The Act consists of 64 sections divided into 9 Parts: Preliminary (I); Titles to native land (II); Alienation (III); The Land Court (IV); Lands Code (V); Leases (VI); Survey (VII); Penalties (VIII); General (IX).Section 4 concerns indefeasibility of title of native title subject to specified conditions. Subject to the provisions of this Ordinance native land shall not be alienated, whether by sale, gift, lease or otherwise, to a person who is not a native (sect. 5).

    The Act facilitates dealings in land by providing for incorporation of owners of native land and powers of assembled owners (preamble). The objects of incorporation include: to occupy and manage the land as a plantation or farm, to use the land for the growing of timber, to engage in coal mining and to arrange for the lease of land (sect. 5). The Court may make an order of incorporation on the application of any persons interested, stating, inter alia, the objects for which the the body corporate is established (sect. 7).

    The Act restricts leases, assignment of leases or subleases. Any such lease requires the approval of the Leases Approval Committee, established in the Act. In considering applications for approval, the Committee shall have regard to any criteria as well as policy directions from the Minister of Justice. Approval is not required for leases under the Short Term Crop Leases Act or any lease for a term not exceeding five years. It further provides for application, procedures of the Committee, regulations.

    This Chapter makes provision for the administration of estates of deceased persons. The estates of deceased persons shall be administered in the Trial Division of the High Court, which shall have exclusive jurisdiction over such estates. Section 5 defines the priority for granting letters of administration of estates to relatives, creditors or persons appointed by the trail division of the High Court. Sections 6 and 7 concern qualifications of administrators and executors.

    This Chapter makes provision for guardianship in relationship with adminsitartion of estates of a minor or of a person who is for any cause mentally or physically incompetent to manage his own property. Guardianship proceedings shall be administered in the Trial Division of the High Court, which shall have exclusive jurisdiction over guardianships. Section 3 defines the qualifications of guardianship. Every guardian shall have power to sell the personal estate which has come into his hands, under such terms and conditions as may be imposed by the Trial Division of the High Court.

    This Chapter provides for certain aspects of inheritance of real property. When any person having any title to any real property dies without disposing of such real property by will, it shall be succeeded to and must be distributed, subject to the payment of debts and the rights of dower, in the manner as set out in section 2. If there is no one capable of succeeding to either real or personal property, the real and personal property of the decedent shall escheat to the government as the ultimate heir.

It defines certain requirements regarding execution, rights of spouse of the deceased person and legal procedures. A surviving spouse may elect to take dower instead of property devised or bequeathed to such spouse.

    The Provisions of this Chapter regulate certain aspects of the creation and enforceability of mortgages on real property or fixtures. Every transfer of an interest in real property or fixtures made as security for the performance of another act or subject to defeasance upon the payment of an obligation, whether the transfer is made in trust or otherwise, is to be considered a mortgage and shall create a lien only as security for the obligation and shall not be deemed to pass title.
