    This Chapter provides for certain aspects of the enforcement of a mortgage. The High Court may assess the amount due upon a mortgage whether of real or personal property, and shall render judgment for the amount awarded, and the foreclosure of the mortgage. Execution may be issued on the judgment, as ordered by the court. All prior and subsequent mortgage creditors whose names are or can be discovered by the party foreclosing a mortgage, shall be made parties to the action.

    This Chapter provides for certain matters relating to title in land. The owner of any land in American Samoa, not previously registered, may register his or her title thereto with the Territorial Registrar, but no title shall be registered unless the Registrar is satisfied that there is no conflicting claim thereto and unless the description clearly identifies the boundaries of the land. Every registration shall specify whether the land is registered as family owned communal land or individually owned land.

    This Act provides for the establishment of coastal management program and the designation of coastal zone and special management areas and related matters. The American Samoa Coastal Management Program (ASCMP) is established as an office within the Executive branch. The Office of Development Planning shall be the designated territorial agency, as required by federal law, for the administration and implementation of Program. The general purpose of ASCMP is to provide effective resource management by protecting, maintaining, restoring, and enhancing the resources of the coastal zone.

    The Act makes provisions for the validation of leases of land concerned to the Cook Islands Government Property Corporation, for the preservation of rights of owners of leased lands, for the determination of interests of successors, for the establishment of the Naharakura Development Trust and for the payment of proceeds of leases into the Trust.The leases set out in the Schedule are confirmed provided that owners may seek adequate compensation for the alienation of rights. An application for this purpose may be made by any owner of the leased lands to the Land Division of the High Court.

    This Act declares that the King may by will or by deed or by any other means confer on and grant to any person s specified title in land and other real property. This title shall become hereditary but where a person cannot succeed to, or continue to hold, the title and estates for specified reasons, the title and estates shall revert to the Crown.

    A new Part (VIA) on easements is inserted. An "easement" is defined in section 112A as "a right annexed to land to utilise other land of different ownership in a particular manner (not involving the taking of any part of the natural produce of that land or of that land or of any part of its soil) or to prevent the owner of the other land from utilising his land in a particular manner". The same section declares the following rights of easements permissible: (a) right of way; (b) right to convey water; (c) right to drain water; (d) right to drain sewage.

    An amendment regarding the publication of a notice of the consent of the Cabinet to surrender of land. The Notice shall be in the form specified in the new Schedule IVA and will require any person claiming to be the legal successor to the surrendered land to lodge his or her claim in writing to the allotment or part thereof by the date specified in the notice, which shall not be less than 12 months from the date that the notice is first published. If no claim is lodged, the said allotment or part thereof will revert to the estate holder. Section 87 is amended accordingly.

    Section 140 of the Principal Act is deleted and replaced with the following: "(1) Any party may, upon payment of the prescribed fee, appeal from any order or judgment of the Court: (a) if the order or judgment relates to the determination of hereditary estates or titles, to the Privy Council pursuant to Clause 50 of the Constitution; (b) in every other case, to the Court of Appeal. Any such appeal shall be made in such manner as may be prescribed by rules of court within 42 days of the date of the order or judgment appealed.
