This Act amends the Leases Restrictions Act 1976 in section 2 by the defining "Minister" as the Minister of Justice. It also redefines the functions of Leases Approval Tribunal, repeals section 6 inserts a new section by stipulating that nothing in the Unit Titles Act 2005 shall affect the principal Act.

This Act concerns limitations applying to legal action such as actions of contract and tort; actions to recover land, registered title and rent; actions to recover money secured by a mortgage or charge or to recover proceeds of the sale of land; actions in respect of trust property or the personal estate of deceased person; and actions against the government and public authorities, etc. The Act also concerns accrual of right and relative limitations and extension of limitation periods in case of disability, acknowledgment, part payment, fraud and mistake.

This Act consists of 63 sections divided into 11 Parts: Preliminary (I); Acquisition of mineral rights (II); Administration (III); Reconnaissance licences (IV); Prospecting licences (V); Mining licences (VI); Mineral rights and surface rights (VII); Financial (VIII); Withdrawal of applications (IX), Surrender and termination of mineral rights (X); Regulations (XI); Penalties and offences (XII); Records, information and arbitration (XIII).Mineral rights shall be granted only to citizens of Tuvalu or to a corporation that is incorporated by or under any law of Tuvalu (sect. 3).
“Minerals" is defined in section 2. It shall include gas and petroleum but not clay, coral, lime, sand, or other stone or such other common mineral substances as the Prime Minister may by notice in the Gazette declare not to be minerals for the purpose of this Act. Section 3 formulates a reservation to the Crown of all minerals. Exploration licences which allow the holder to enter upon land, whether private or public to explore for mineral resources, may be granted by His majesty in Council under section 5.
The Act consists of 46 sections divided into 7 Parts: Preliminary (I); Administration (II); Acquisition of land (III); Grant of licences (IV); Compensation (V); Regulations (VI); Miscellaneous provisions (VII).There shall be a Chief Mining Inspector, a Mining Office and Mining Inspectors. The Mining Office shall be under the control of the Chief Mining Inspector. Duties and powers of Mining Inspectors are set out in sections 6 to 8.
This Chapter provides for certain aspects of the enforcement of a mortgage. The High Court may assess the amount due upon a mortgage whether of real or personal property, and shall render judgment for the amount awarded, and the foreclosure of the mortgage. Execution may be issued on the judgment, as ordered by the court. All prior and subsequent mortgage creditors whose names are or can be discovered by the party foreclosing a mortgage, shall be made parties to the action.
The Provisions of this Chapter regulate certain aspects of the creation and enforceability of mortgages on real property or fixtures. Every transfer of an interest in real property or fixtures made as security for the performance of another act or subject to defeasance upon the payment of an obligation, whether the transfer is made in trust or otherwise, is to be considered a mortgage and shall create a lien only as security for the obligation and shall not be deemed to pass title.
This Act provides for spatial development of Tonga and in particular, among other things, provides for the fair, orderly, economic and sustainable use, development and management of land including the protection of natural and man-made resources and the maintenance of ecological processes and genetic diversity. It establishes the National Spatial Planning Authority and appoints the Minister for Lands as the Authority. The principal function of the Authority shall be the implementation of the provisions of this Act in accordance with its objectives.
