L’Afrique de l’Ouest et centrale abrite 25 % des forêts tropicales de la planète. La déforestation y est une préoccupation centrale au défi climatique. Tanzania and Mozambique — countries of vast mountain ranges and open stretches of plateaus — now face a growing land problem. As soil degradation, climate change and population growth place enormous strains on the natural resources that sustain millions of people, multinational companies are also gunning for large swaths of land across both countries. Caught between these pressures, many poor, rural communities get displaced or decide to sell their collectively held land.
The research provides a holistic overview of the key changes that affected Northern Chin society from pre-colonial times up to now in villages close to Hakha town where State penetration was stronger than in more remote
areas. The study sheds light on the overlapping and evolving statutory and customary land systems and on the issues faced by contemporary Chin communities as they seek to govern land and natural resources.
They has been a growing emphasis on the importance of lease held tenure and the benefits it offer’s to a country’s economic growth and development. The Food and Agriculture Organization define land tenure as the relationship, whether legally or customarily defined, among people, as individuals or groups, with respect to land. Researchers and social scientists continue to advocate for lease held tenure while customary tenure has been associated with insecurity due to the lack of formal administration.
We believe that law should in principle assist vulnerable communities in changing power relations. Law is fundamentally a ‘neutral’ set of rules that constrains power by requiring decisions and actions of those in power to comply with legal rules, rights and obligations. Land in the Zeliangrong community is controlled under the customary land tenure system in which the village owner (Nampou) governed granting equal access to all the families within groups with common lineages.
