Eltelt két évtized és hazánk, valamint az agrárvilág újra attól hangos, mint két évtizeddel ezelőtt, hogy kié lesz a föld? Ebben sok minden közrejátszott, de mindenekelőtt az, hogy a rendszerváltozáshoz ziláltan érkezett az agrárgazdaság, a vidék, s a földek reprivatizációja helyett kárpótlásra került sor, elmaradt a parasztság rehabilitációja, s főleg hogy egyetlen kormány sem foglalkozott stratégiai, szociális, környezetfenntartó súlyának megfelelően a vidékkel, a mezőgazdasággal. Ugyan 2001-ben lépéseket kezdeményeztek a családi gazdaságok felkarolására, de ez nem folytatódott.

Társadalmunk gazdasági fejlődése a természeti erőforrások használatára épül. A földtulajdon és a földhasználati rendszer hatékonysága hazánkban és az EU-ban is a figyelem középpontjában áll. A birtokstruktúra és a földhasználat döntően befolyásolják a gazdálkodás eredményességét. A Kormány a Nemzeti Földalap létrehozásával gátat kíván szabni a földspekulációnak. Vidéken a föld racionális használata megkerülhetetlen. A kritikus gazdasági helyzetű térségekben a mezőgazdasági tevékenység – mint a megélhetés egyetlen forrása – felértékelődik.

A „Gazdálkodás” 2010. évi 2. számában vitacikkem jelent meg „A földbirtok-politikaválaszt igénylő kérdései” címen. Ezzel az volt a célom, hogy a témakörrel kapcsolatban felvessek kérdéseket, leírjak megállapításokat, és ezzel egy olyan vitát generáljak, ami fórumot ad a tudományos közélet szereplőinek a megszólalásra, a vélemények ütköztetésére, egymás nézeteinek jobb megértésére, a politika számára javaslatok megfogalmazására.

A kérdések széles területet ölelnek fel, ami folytatható a földvédelemmel, a kör-nyezetvédelemmel, a földadó kérdésével stb. A politikának – kompromisszumokkal és megegyezéssel – mielőbb lépnie kell, mert a rendezett birtokviszonyok növelik a földárat, élénkítik a termőföld iránti keresletet. Az emelkedő árak ugyanakkor bővítik a földkínálatot, végeredményben élénkül az egész földpiac. Ez a leghatékonyabb eszköz a termőfölddel kapcsolatos spekulációk visszaszorítására.Van-e azonban esély a megegyezésre? Politikai síkon aligha!

Foreign legal or natural persons may acquire the ownership of real estates, other than arable land or protected natural area, after obtaining the permit of the responsible public administration office of Budapest or the county. The permit has to be issued if the acquisition of ownership by foreign persons does not hurt the local government's or other public interest, and if the buyer does comply with certain requisites. The issuance of a permit may be refused if Hungarian persons are not treated equally, in this regard, to local people in the country of origin of the buyer.

The intention of this Decree-Law is to enable, exceptionally, the State or the local government to acquire the ownership of private estates, through expropriation for public interest determined by Article 4 of the Decree-Law, against immediate, complete and absolute compensation. The compensation can be an other estate or money or both of them. The expropriation procedure is duty of the territorially competent commissary of the Republic. Proceedings are ruled in detail.

The Land Parcel Identification System is the national identification system of exclusive state property, to be used in administrative procedures of area payments.

This Act establishes the National Land Fund with the purpose of: a reasonable management of state-owned arable lands, promoting ecological agricultural production and economic efficiency, and creating a modern landed property structure based on family farms. Property rights in regard of the Fund are exercised by the Minister of Agriculture and Rural Development. He has to report annually to the Parliament on the situation of the Fund and of the managing organization.

The Hungarian State Holding Company (MNV Zrt.) may purchase agricultural land through tendering procedure from land owners (hereinafter: entitled) for the benefit of the State, for a maximum of 20 acres and a minimum of 1 acre per owner of lands in non-urban areas, for a total value of 3 million HUF, and paying for it with a life annuity according to the provisions of this Decree.
