Au Maroc, l’intérêt porté au thème des communs est assez récent même si, traditionnellement, l’accès aux ressources partagées était régulé par des principes communautaires issus des règles coutumières (orf) et/ou des normes du droit islamique (chraa) (Lazarev, 2005 ; Rachik, 2016). La gestion collective des ressources agrosylvopastorales s’inscrit dans la longue histoire de la paysannerie marocaine, où les communautés humaines, structurées en tribus, jouissaient durant la période précoloniale d’une relative autonomie de décision par rapport à l’État central (makhzen).

The vast majority of land in Afghanistan is untitled and unregistered, further complicating the Afghan state’s ability to help sustainably resolve land disputes. The United States Institute of Peace (USIP) and the Afghanistan Land Authority sought to address this problem by testing a new model of engaging community dispute resolution in formal land registration. This report examines the lessons learned from the pilot and proposes recommendations for reform.

On July 21, 2011 the then Acting Prime Minister Sam Abal announced the establishment of a Commission of Inquiry to investigate 77 land leases which were issued under the Somare government’s Special Agriculture & Business Leases (SABL). The inquiry, which was later extended by Prime Minister Peter O’Neill in October 2011 for a further five months, discovered that over 90 percent of the leases totalling over 5 million hectares were illegally obtained from traditional landowners (Zealand, 2015).
