Since the 1970s and 1980s, community-based forestry has grown in popularity, based on the concept that local communities, when granted sufficient property rights over local forest commons, can organize autonomously and develop local institutions to regulate the use of natural resources and manage them sustainably. Over time, various forms of community-based forestry have evolved in different countries, but all have at their heart the notion of some level of participation by smallholders and community groups in planning and implementation.

Land acquisitions, either driven by foreign investments or domestic investment needs have continued to polarize opinions. Land is therefore a central commodity for realization of the sought after socioeconomic transformation.

This short thematic study challenges the assumption that the legal framework to recognize and protect indigenous peoples’ (IP) customary lands is adequate and that the challenge lies in its implementation. With support from MRLG, a core group of IP NGOs of the Cambodia Indigenous Peoples Alliance (CIPA) held a series of seminars to scrutinize this legal framework, identify gaps and make recommendations for a revision of the supporting legal framework. The thematic study documents this joint reflection.

The process ensures that communities can participate in decision-making processes and that their concerns, priorities and preferences are accommodated in any project affecting their lands, territories and resources.
