These Regulations, made by the Minister of Rural Development and Land Reform under section 54 of the Spatial Planning and Land Use Management Act of 2013, concerns establishment by municipalities of (joint) Municipal Planning Tribunals and related matters. The decision of a municipality to: (a) establish a joint Municipal Planning Tribunal as contemplated in section 34(1) of the Act; or (b) agree to the establishment of a Municipal Planning Tribunal by a district municipality as contemplated in section 34(2) of the Act; or (c) establish a Municipal Planning Tribunal for its municipal area, may be preceded by an assessment of defined factors. The Regulations, among other things: set out institutional requirements for establishment of Municipal Planning Tribunals; provide for monitoring of Tribunals; provide with respect to submission of land development and land use applications and decisions relating to such applications by municipalities; provide with respect to appeal procedures for the lodging and consideration of appeals contemplated in section 51 of the Act. A joint Municipal Planning Tribunal shall be established by agreement between two or more municipalities.
