    Foreign legal or natural persons may acquire the ownership of real estates, other than arable land or protected natural area, after obtaining the permit of the responsible public administration office of Budapest or the county. The permit has to be issued if the acquisition of ownership by foreign persons does not hurt the local government's or other public interest, and if the buyer does comply with certain requisites. The issuance of a permit may be refused if Hungarian persons are not treated equally, in this regard, to local people in the country of origin of the buyer.

    The intention of this Decree-Law is to enable, exceptionally, the State or the local government to acquire the ownership of private estates, through expropriation for public interest determined by Article 4 of the Decree-Law, against immediate, complete and absolute compensation. The compensation can be an other estate or money or both of them. The expropriation procedure is duty of the territorially competent commissary of the Republic. Proceedings are ruled in detail.

    The Land Parcel Identification System is the national identification system of exclusive state property, to be used in administrative procedures of area payments.

    This Act establishes the National Land Fund with the purpose of: a reasonable management of state-owned arable lands, promoting ecological agricultural production and economic efficiency, and creating a modern landed property structure based on family farms. Property rights in regard of the Fund are exercised by the Minister of Agriculture and Rural Development. He has to report annually to the Parliament on the situation of the Fund and of the managing organization.

    The Hungarian State Holding Company (MNV Zrt.) may purchase agricultural land through tendering procedure from land owners (hereinafter: entitled) for the benefit of the State, for a maximum of 20 acres and a minimum of 1 acre per owner of lands in non-urban areas, for a total value of 3 million HUF, and paying for it with a life annuity according to the provisions of this Decree.

    Contracts affecting property rights of land and for the registration of these contracts in the cadastre must be laid down by a legal counsel on sheets of paper bearing the requisites foreseen in Article 2. Such contracts shall be registered with the competent district land office and shall be kept in a safe place by the legal counsel.

    This Decree establishes that the competent authority for real estate issues is the countrywide network system of land offices (territorial and local offices). They are responsible for registration of legal transactions, cadastral mapping changes and dealing with land and other real estate property-related activities. The Hungarian Land Register is owned and maintained by the Ministry of Rural Development. This Decree establishes also the Institute of Geodesy, Cartography and Remote Sensing as the institutional body for land surveying and geo-information.

    This Decree applies to arable and, exceptionally, to uncultivated lands forming part of the state-owned propriety, which are managed by the Hungarian National Land Fund Company according to the principles of land tenure policy. The Company keeps an inventory of the assets of the Fund and determines the utilization of lands. There are detailed rules regarding the method and the content of data to be registered and the plan for the utilization of lands (sale or lease through tender).
