    This Decree provides for certain dealings in land related to a loan facility and relative mortgages and title in native land for the development of a coastal area. The Decree seeks to protect funds advanced by the Fiji National Provident Fund by providing for accelerated transfer of title and relative registration by the Land Registrar. Land involved in these dealings includes native land covered by a Land Swap Agreement for which the Native land Trust Board holds specified powers.

    This Act amends various enactments including the Forestry Act. That Act is amended in section 72 by adding after paragraph 71(2)(d) a new provision “(da) the requirements for the importation of sawn timber and wood products". and by inserting a new section 13A which requires the Customary Land Tribunal to consult the Council of Ministers, the Minister and the Director General of the Ministry of Finance before making any determination.

    This Act establishes the Building Permits Evaluation Committee within the ministry responsible for industry and trade and provides with respect to procedures for the application for building permits and granting of building permits by the Commission. A “building permit” means a building permit referred to in the Public Health Act 1935 and its subsidiary laws.

    This Act provides with respect to local government in accordance with section 187B of the Constitution, which requires an Organic Law to provide for, or make provision in respect of, the form and the manner of establishment of the Provincial Governments and the Local-level Governments. The system of Provincial Governments established by this Organic Law applies to the government of the National Capital District and the provisions of this Organic Law relating to Provincial Governments apply to the National Capital District.

    This Act provides rules for the registration of title or other interests in land and related matters and provides for the form of transfer of title in land or other interest in land such as mortgages, caveats, leases and easements.There shall continue to be a Registrar of Land who shall be the Chief Executive Officer responsible for the administration of this Act. The Registrar may delegate the Registrar’s powers and functions to the Assistant Registrar of Land.

    This Act provides for the establishment of Customary Land Advisory Commission. The Commission shall, among other things: (a) recommend to Cabinet suggested measures for the facilitation, encouragement and promotion of the economic use of customary land in Samoa; (b) review all laws affecting customary land in Samoa and make recommendations to Cabinet for changes to such laws where such are necessary for the facilitation, encouragement and promotion of the economic use of customary land.

    The administration, control, custody and management of the Coastal Zone, and the general administration and implementation of the provisions of this Act are hereby vested in the National Environmental Protection Authority. "Coastal Zone" means the area laying within a limit of twenty five (25) feet landwards of the mean high water line and a limit of two hundred feet seawards of the mean low water line. The Authority shall appoint a Director of Coast Conservation.
