    The Act makes provision for various matters relating to land survey in Malawi, It establishes the Land Surveyors Registration Board and the he Malawi Geographic Information Council and provides with respect to licensing, registration and duties of surveyors. The Council shall be the sole authority for licensing and registering spatial data in Malawi. Survey plans shall be deposited with the Surveyor General and shall be property of the Government.

    This Act amends the Land Act: in section 2 by inserting a new definition of “person who is not a citizen of Malawi”; in section 5(1) which restricts the making of a grant of any public land or any customary land to any person who is not a citizen of Malawi; in section 40 on proof of citizenship of Malawi; by adding new sections (24B, 24C and 24D) which place restrictions on the grant of private land to any person who is not a citizen of Malawi.

It sets forth the provisions to prepare, approve and a deposit a plan and establishes an administrative framework for development planning. The Act also provides for development control and enforcement. It consists of 99 sections divide into 10 Parts.The Act establishes the Physical Planning Council and the Physical Planners Board. There shall also be a Commissioner for Physical Planning.

    This Act makes amendments to the Forestry Act consequential to the entry into force of the Customary Land Act, 2016. It inserts in section 2 the definition of the "customary land committee" and "local government authority" and amends section 26 by inserting the words "the Minister responsible for physical planning," immediately after the words "the Minister responsible for land matters", section 30 by replacing the words "any village headman' with the words " a customary land committee" and section 32 by replacing "District Councils" with "local government authorities".

    This Act provides for the power of the Minister to acquire land for public purposes and related matters. The Minister may, whenever he or she is of the opinion that it is desirable or expedient in the interests of Malawi so to do, acquire any land, either compulsorily or by agreement, paying such compensation therefor as may be agreed or determined under this Act. The procedures for acquisition foresee a preliminary investigation, a Notice of intention to acquire and a Notice to surrender property.

    This Act amends the Local Government Act in provisions concerning land matters consequential upon the enactment of the Land Acquisition (Amendment) Act 2016 and the Land Act 2016. Also the word "Local Authority" is replaced by the word " Local Government Authority" wherever it occurs in the principal Act and provisions regarding the delegation of functions to committee by an Authority, the disposal of land, the designation of an area as a rateable area, the valuation of property, and charges on property. Three new sections are inserted in the principal Act (78A-C).
