    These Regulations, made under section 272 of the Agricultural (Commercial) Land Reform Act, establish require certain particulars to be furnished in connection with an offer to sell agricultural land to the State under section 17 of the Act. They also prescribe forms for a certificate of waiver referred to in section 16 of the Act and an application for an option to purchase a farming unit in terms of section 47(2) of the Act.

    These Regulations, made in terms of section 45 of the Communal Land Reform Act, concern the application for and the registration of an occupational land right. An application for an occupational land right is made in the form of Form E as set out in Annexure 1 to the communal land board. An occupational land right was introduced in the principal Act by the Communal Land Reform Amendment Act, 2013 and means a right to occupy a portion of communal land for the provision of public services granted under section 36A.

They make provision with respect to an application for consent to sublet farming unit and rent, defines size of farming unit to be sublet and the duration of a sublease, prescribe conditions on subletting farming units by sub-lessees and prescribe conditions on grazing livestock.

    This Act converts the National Special Risks Insurance Association established in terms section 21 of the Companies Act, 2004 into a public company having a share capital, with shares held by the State. It also determines the nature and ambit of the special risks that the Company may underwrite and the role of the State in the short-term insurance industry as regards special risks and to reduce the reinsurance risk exposure of the State. One of the risks that may be covered is loss in respect of a mortgage loan. Risks may arise from political strife or public disorder.

The Tribunal may consist of one or more divisions as the Minister may consider necessary to constitute, each headed by a Land Tribunal President. The Minister shall appoint the Chief Land Tribunal President.     Section 3 formulates a prohibition of receipt or solicitation of consideration in respect of unlawful occupation of land. Section 4 makes provision for the eviction of unlawful occupiers of land. Notwithstanding the provisions of section 4, the owner or person in charge of land may institute urgent proceedings for the eviction of an unlawful occupier of that land pending the outcome of proceedings for a final order, and the court may grant such an order if it is satisfied that conditions set out in section 5 are met. Section 6 provides for eviction at the instance of an organ of state.
