These Regulations, made by the Member of the Executive Council of the Province of Gauteng under 27 the Development Facilitation Act, 1995, provide procedural rules relative to the setting and reviewing land development objectives for each local government area in the Gauteng Province under supervision of the Member of the Executive Council (MEC) as provide for by Chapter IV of the Act.

An application for an occupational land right is made in the form of Form E as set out in Annexure 1 to the communal land board. An occupational land right was introduced in the principal Act by the Communal Land Reform Amendment Act, 2013 and means a right to occupy a portion of communal land for the provision of public services granted under section 36A.

This By-Law made under the Spatial Planning and Land Use Management Act, 2013, applies to all land within the geographical area of the Ndlambe Municipality, including land owned by the state. The By-law shall, in case of conflict, in principle prevail over other legislation. The By-law requires a municipal spatial development framework to be made and provides with respect its preparation and public participation procedures. The Municipality may also adopt a local spatial development framework for a specific geographical area of a portion of the municipal area.
